WHEREAS, THE OWNER OF LOT '~ , BLOCK ~ , OF THE
(ADDRESS), COPPELL, TEXAS (THE OWNER) UNDERSTAND AND ACKNOWLEDGE
THAT THE LANDSCAPE AND/OR STONE RETAINING WALL WHICH IS LOCATED
ON THEIR PROPERTY ENCROACHES ONTO THE CITY OF COPPELL'S SANITARY
SEWER EASEMENT; AND
WHEREAS, THE OWNERS UNDERSTAND AND ACKNOWLEDGE THAT IN
CASE REPAIRS OR IMPROVEMENTS ARE REQUIRED TO BE MADE TO THE CITY
OF COPPELL'S SANITARY SEWER EASEMENT WHICH WOULD REQUIRE
REMOVAL OF THE LANDSCAPE IN ORDER TO EFFECT SUCH IMPROVEMENTS;
AND
WHEREAS, THE OWNERS RECOGNIZE AND ACKNOWLEDGE THAT SUCH
LANDSCAPE WAS INSTALLED DESPITE KNOWLEDGE OF THE CITY'S SANITARY
SEWER EASEMENT;
OWNERS HEREBY AGREE TO REMOVE SUCH LANDSCAPE AND/OR STONE
WORK AT THEIR OWN COST AND UPON REQUEST BY THE CITY OF COPPELL,
AND IF OWNERS FAIL TO REMOVE THE LANDSCAPE AND/OR STONE WORK
UPON REQUEST BY THE CITY, THEN CITY WILL REMOVE SUCH LANDSCAPE
AND/OR STONE WORK AND OWNERS HEREBY INDEMNI~Y AND HOLD THE CITY
HARMLESS FROM ALL CLAIMS OF DAMAGE TO THE LANDSCAPE AND/OR
STONE WORK WI-I~CH ARISE FROM THE CITY'S REMOVAL OF SUCH LANDSCAPE
AND/OR STONE WORK WHILE REPAIRING, INSPECTING, IMPROVING OR IN ANY
WAY SEEKING ACCESS TO THE SANITARY SEWER EASEMENT. ADDITIONALLY,
OWNERS AGREE TO REIMBURSE THE CITY FOR REASONABLE COSTS INCURRED
IN REMOVING THE LANDSCAPE AND/OR STONEWORK.

Representative(s) of the Franchise/Contractor must adhere to all
construction standards approved by the City of Coppell, which
includes but is not limited to: Compaction of Trenches and Bores,
and Barricading according to the Texas Manual on Uniform Traffic
Control Devices. Ancea(s) affected must be restored to as good
condition as before the commencement of work.
Any excavation requiring closing of a street or alley must be
reported to the Police, Fire, and Public Works Departments prior
to closing (462-1144, 462-1133 and 462-8495).

and eve~! claim, demand or cause of action that may be made or come
against it by reason of or if any way arising out of the closure,
blocking, excavating, cutting, ~unneling, or other work by the
applicant under permit from the City, if such permit is granted.

Ail contractors will contact Public Works @ 462-8495 to have
trenches and/or open cuts inspected prior to back fill operation
taking place. Staff will be sent to inspect the project.
