1. City or Develope~ agrees to pay Company $.__ in cons~clerafion of Company's agmemera to install said street
lights and uncb...h,,~ls that no constn~tlon work will begin until after Company has received full payment.
2. Company agrees to install, own, operate and mairdain said street lights in accordance with its street lighting agr#-
ment with customer. However, if City or Developer fails to pay, on demand, the amount indicated above, this supple--
mental agreement is aufommicolly terminc~d.
3. All parties agree that Company vail retain for its use and benefit the payment received hereunder in consideration of
its obligation to install said street lights and that Company at all times has title to, and complete ownership and control
of, said street lights.
4. Company is not liable for loss or injury caused by delay or failu~b to install rite electric facilities necessary to ser~e
cmtomer bemuM of delay in receiving shipments of required WoI, orders or fomml requests of governmental
agencim, ach of God or 1he public enemy, inevitable accidents, tim, implMiom, ~trikm, riots, war, or any other cau#s
mmonobly beyond co~r~: of Company. ff Comlmny is pmmnt~ from installing such electric facilities by any of the
above mums, Company agrem to rMum to City or Developer, wilhout intered, the entire amount of City or Developer's
payment, 1hereby terminating this supplement and Comlmny's obligation to provide 1he elect~c facilities dmc~bed herein.
5. This agreement is entered into subjed to 1he terms of the Agreement for Street Lighting Service between City and
Company doted
