ITI~ 9 ANALYS I S: Although staff had strongly recom~ended against approving the zoning which preceded this plat, Planning Commission recommended (3-2) that zoning be granted. This plat conforms to the basic conditions of PD-SF-? zoning. A private park was requested by Commission. This private park was proposed, and agreed to by the developer, in addition to the 30 acre park site south of this plat. There are basically five (5) concerns with this preliminary plat as a result of staff analysis: 1] it -is not clear how the right-of-way for State Highway 121 Bypass is being dedicated - it doesn't show on either plat, 2) a Homeowners' Agreement needs to be submitted (as well as a Homeowner's Association needs to be established) to assure maintenance of all common open spaces, 3) additional detail on landscaping along 121, Denton Tap, the pocket park, and the common boundary with Lewisville needs to be submitted and approved by Commission, 4) only partial dedication of Denton Tap is shown; how do we acquire the 20 foot dedication through the leave out parcel (zoned HC)? 5) 1800 square foot houses were agreed to during zoning, and indication of minimum air-conditioned square footage should be indicated on the plat. In addition, staff provides you with the zoning approval letter with fourteen (14) conditions listed to insure the developer follows those conditions. As a final comment, remarks were made during the zoning hearing that suggested the M.U.D. issue was being addressed. I have included a letter from Paul Phy to the potential developer of this land, stating the M.U.D.'s concern with this development. The concern stated warrants discussion at the public hearing before taking action on this case. Thompson 8333 Douglas, Suite Dallas, TX 75225 1510 Dear Mr. Thompson: It has come to the District's attention that at the P & Z Hearing on the "Magnolia Tract" on July 1, 1991, it was represented to P & Z that District water and sewer facilities, including temporary service, are available to serve that land. This allegation is not correct and the City will be so advised. Ail requests to connect to District facilities or to obtain new service can only be approved by the District's Board of Directors. The request must be in writing, signed by the landowner or his legally designated agent and provide all necessary engineering and development data required by the District. The District has received no such request. The District's existing facilities were not designed nor are they available to serve the Magnolia tract. Service to the Magnolia Tract will have to be a part of an overall plan to serve all property in Coppell north of Denton Creek in accordance with a plan developed by the District, the City, your predecessor and adjacent property owners several years ago. It will require substantial financial commitments from the owners of the Magnolia Tract and other property owners involved. Accordingly, if you are proposing to purchase the Magnolia Tract, and you propose to connect to the District's water and sewer system, you should promptly make an appropriate written request to the District. Please submit the request to the District at the address shown above. The matter will then be placed on the next available Agenda of a meeting of the Board of Directors. Central Expressway, Suite 300 Dallas, TX 75231 Re: ZC-531 Dear Mike: This letter is to inform you that your request for application of a Zoning Change from Highway Commercial (HC) and Light Industrial (LI) to Single - Family 12 (SF-12), Single - Family 9 (SF-9), Planned Development 9 (PD SF-7), was recommended for approval with conditions by the Coppell Planning and Zoning Commission on Monday, July 1, at the special called meeting. The conditions are as follows: 1) Deny the SF-12 on 30 acres of the park site, allowing the zoning to remain as PD-FP; 2) Retain the. original park concept plan and amenity package commitment submitted in the earlier zoning request and that the specific plan in detail be presented with the plat for Planning & Zoning Commission review and approval; 3) Allow approval of PD-SF-12 on residential lots adjacent to the park amd PD-SF-9 north of the PD-SF-12; 4) Retain the HC zoning on the 4.67 acre parcel at the southwest intersection of the S.B. 121 bypass and Denton Tap Road; 5) In order to insure that the requirements of the streetscape ordinance are met as well as insuring the landscaping developments of the overall tracts, the developor shall present a detailed streetscape plan and a detail landscape plan to incorporate entrance detail as well as the pocket park detail; (6) That the developer provide facilities on the pocket park of so~e sort -- not only landscaping but playgrotmd equipaent; (7) Landscaping shduld address both the north and south side of 121; Letter to Mr. Mike Daniel July 5, 1991 Page 2 S) 9) 10) With regard to the zoning on the north side of 121, approve the PD-SF-7 as submitted and we ask that specific landscape plans should include the berm requirement, which is a 10 foot berm and an 18 to 20 foot screening; North side of S. H. 121 will include a pocket park that was addressed on the site plan; North side of S.N. 121 to include an 8 foot masonry and appropriate green screening elements along wall adjacent to the Light Industrial (L1) zoned parcel located in the City of Lewisville. ll) 12) 13) 14) Submit a detailed plan of the floodplain park area along with the preliminary and final plat; Both the north and south side to have 8 foot masonry screening walls between the residential and the to-be-developed commercial tracts that are within these tracts; On the north side an 1,800 s.f. minimum house size is required; Particularly on the north side, developer should address additional landscaping within the development and should look into the possibility of adding landscaping to the cul-de-sacs end that the details are submitted along with the preliminary plat. The tentative date scheduled for consideration by the Coppell City Council is Tuesday, July 23, 1991, at 7:00 p.m. A representative for this case must be present at the City Council meeting.
