Dear Matt:
Regarding your letter dated November 9 about the above-referenced replat, please
consider our exception to the City's condition that we accept the engineering comments.
Engineering comment six should not be a condition for this replat. This issue regarding
sheet drainage to the Ardinger tract was satisfactorily resolved six months ago per the
City's instructions. Upon the request of the City engineering staff, we furnished an
approval letter from Mr. Ardinger with his consent to allow the drainage as drawn. Mike
Daniel of Nathan D. Maier Engineers represented Mr. Ardinger and approved the Bentley
Engineering design which remains unchanged.
As indicated in the engineering comments throughout the original replatting process
undertaken last spring, this issue was fully resolved with the City upon delivery of the
Ardinger written consent. SCI-Wynnpage subsequently closed on the property relying
upon the City's conditions.
1 attempted to resolve this matter with the engineer assigned to our project, Charleen La
Mattina, explaining that the Engineering Department had apparently made a mistake by
adding this comment which was included in your October 21 letter. She indicated that
there was no mistake and that the issue remains unresolved.
I explained that the Engineering Department was unreasonably using this replat process
to create a new issue after closing. I asked that the comment be removed prior to the City
Council meeting, but Charleen replied that she isn't the only one to decide the issue.
I was not asked to accept any conditions at the City Council meeting prior to their vote
approving the replat. Had I been asked, I would have unequivocally rejected this
interjection by the Engineering Department.
I ask that the City remove this condition and respond in writing that this issue is
completely resolved. We wish to break ground on this project as soon as possible, adding
an additional $3 million dollars in value to the tax rolls.
