In speaking with Mr. Frank Trando, Interim City Manager, regarding this matter, we discussed the relevancy of filing a Homeowners Agreement for this particular plat. The streetscape ordinance does call for a Homeowners Agreement. In reviewing this ordinance it was felt that the Homeowners Agreement was primarily for the purpose of ensuring that the use and management of the common areas would be properly addressed and the maintenance obligations performed. The Northlake Woodlands East Phaae VI plat does not appear to have common areas. Therefore, if the Homeowners Agreement is solely for the above purpose, Mr. Trando and I feel that an Agreement would not be necessary. His request is to replat these two lots into a s~ngle lot, which will be designated as Lot 9-R, Block J. S~nce tbJs development has been previously reviewed and approved by the ?la~ning and Zoning Commission and the City Council, and no underground utilities or street paving will be changed; we are requesting that we be allowed to bypass the Planning and Zoning Commission, as authorfzed in Section VI, page 2, Procedures for Subdivision, of the Cfty of Coppell Subdivision Ordinance, and submit this request directly to the City Council for their approvel or disapproval. Please consider placing this item on the October 28, 1986 City Council agenda.
