Dear Mr. Griffm:
This is in response to your August 22, 1995, letter concerning the proposed project. It has been
determined from a review of the information you provided that an Application for Approval of
Reclamation Project need not be fred for the referenced project.
The Texas Natural Resource Conservation Commission (TNRCC) does not have jurisdiction over
the referenced matter, since it is within the Cities of Coppell and Dallas and does not come
under the purview of the TNRCC's authority under Section 16.236 of the Texas Water Code.
The cities, by virtue of their participation in the National Flood Insurance Program, and in
accordance with Section 16.236 (d) (3&4), have approval authority over the matter.
If the cities have not already done so, they should insure that the proposed project is in
compliance with their Flood Hazard Prevention Ordinances and with Section 16.236.
