It.is expressly understood that the State Department of Highways and Public
Transportation does not purport, hereby, to grant any right, claim, title,
or easement in or upon this highway; and it is further understood that the
State Department of Highways and Public Transportation may require the owner
to relocate this line, subject to provisions of governing laws, by giving
thirty (30) days written notice.
You are requested to notify this office prior to commencement of any routine
or periodic maintenance which requires pruning of trees within the highway
right-of-way, so that we may provide specifications for the extent and meth-
ods to govern in trimming, topping, tree balance, type of cuts, painting
cuts and clean-up. These specifications are intended to preserve our con-
siderable investment in highway planting and beautification, by reducing
damage due to trimmin9.
The installation shall not damage any part of the highway and adequate pro-
visions must be made to cause minimum inconveniences to traffic and adjacent
property owners. In the event the Owner fails to comply with any or all of
the requirements as set forth herein, the State may take such action as it
deems appropriate to compel compliance.
Minimum clearances above the roadway for aerial utilities shall be 22' for
power lines and 18' for communications lines.

A 12" diameter water main is to be installed by open cut methods for approximately
]692 L,F. within the state highway R.O.W., said main to be located lO' from
the eastern R.O.W. boundary as shown on attached Drawing A. Approximately 75 L.F.
of 12 gauge 18" diameter corrugated metal encasement to be provided for that portion
of the main lying under Corporate Park Boulevard.
The line will be constructed and maintained on the highway right-of-way as
shown on the attached drawings and as directed by the State Department of
Highways and Public Transportation in accordance with governing laws.
Our Firm further understands that the State considers proper traffic control
measures as those complying with applicable portions of the Texas Manual of
Uniform Traffic Control Devices required for adoption by the "Uniform Act
Regulating Traffic on Highways" (V.C.S. 6701d).
The location and description of the proposed line and appurtenances is more
fully shown by Drawing A attached to this
notice.

UTILIT~ INSTALIATION SPECIFICATIONS
1. GENERAL
A copy of this authority for utility installation on highway right of
way shall be kept on the Jobsite at all times during the proposed work.
Unless arranEements are made with the designated State Department of Highways
and Public Transportation (herein after called Department) representative,
no work shall be performed on Saturdays, Sundays or holidays.
2. COORDINATION OF WORK WITH DEPARTMENT RESIDENT ENGINEER
If any part of the related highway is under construction, the Utility
or its Contractor shall contact the Department Resident Engineer before enter-
lng the project. All work shall be coordinated with the State Contractor as
directed by the Department Resident Engineer.
3. TRAFFIC SAFETY] BARRICADES~ WARNING SIGNSt ETC.
Traffic control and protective devices shall be used and must conform
to the Texas Manual on'Uniform Traffic Control Devices for Streets and Highways.
Barricades, warning signs, flares, flashing devices, and flagmen shall he
provided by the Utility Owner or his Contractor when deemed necessary by
either a Department Representative or a Utility Owner Representative. Any
above ground obstruction or underground boring pit, actually located closer
than the specified horizontal offset as outlined on the Special Specifications
Sheet attached hereto, shall be protected by barricades, signs, flares, and/
or guard fence as deemed appropriate.
Vehicles, equipment, construction material, and personnel not necessary
to the timely installation of the facility shall be kept off the traveled way
and shoulders to provide minimum interference and hazards to the travelling
public. No construction operations relative to installation of utilities will
be permitted within the limits of existing pavements carrying traffic, or
shoulders adjacent thereto, unless specifically authorized by the Department.
Excavated raaterials shall be kept off pavements at all times.
4. STAKING OF UTILITY INSTALLATIONS IN ADVANCE OF CONSTRUCTI(AN
All utility installations shall be staked well in advance of construction
so that the Department may inspect the staking to verify that alignment and
grade conform to the requirements set out herein and that there is no conflict
with highway facilities.
Utility Owner shall give the Department not less than 48 hours notice
ahead of time when the staking of installations will be completed so that
erransements may be made for checking the alignment and grade. Ultimate
responsibi'lity for accuracy of staking and installation rests with the Utility
Owner. There is no responsibility assumed by the Department to check every

installation. The waiver of the right to check the utility company's stakes
and installation does not relieve the Utility Owner of his obligation for
eccu~acy.
5, TIHE PERIOD ALL~4ED FOR INSTALLATION
If the installation of the work covered by this utility notice has not
been started within 6 months from the approval date, the approval is void.
It is expected that the instalk tion will progress to completion in an e£fi-
cient manner. If the work progress is delayed, interrupted, or abandoned
for a period of 2 months or more, written application shall be sumitted to
continue under the authority of the originally approved utility notice. No
work shall be resumed within the limits of highway right of way until a
written approval is received.
ASSUMPTION OF UTILITY PROJECT BY STATE DEPARTMENT OF HIGHWAYS AND PUBLIC
TRANSPORTATION
It shall be the right of the Department to take charge of and to remedy
any immediate hazard to public property or threat to the travelling public
when it is obvious the utility owner will not do so. Any costs associated
with such forced completion will be charged to the Utility Owner. Unusual
traffic conditions, weather conditions, soil conditions, abandonment of the
work (temporary or permanent), unusually slow progress causing a boring pit
to remain open beyond a reasonable period of time, etc. may be factors con-
sidered in the action deemed necessary.
FULL TIME SUPERVISION AND INSPECTION
The Utility Owner shall provide competent, full time, on-the-site super-
visors or inspectors for all utility installations placed within the limits
of highway right of way. These representatives shall be knowledgeable and
shall have the authority to issue instructions to Utility Owners' forces or
to their contractors.
8. RESTORATION OF HIGHWAY RIGHT OF WAY
No removal of trees or shrubbery of value to the highway shall be made
except when Justified by conditions and authorized by the Department. If
removal is permitted, it shall be contingent upon replacement in kind by the
utility firm.
Before final completion of work within the limits of highway right of way,
final clean up shall be completed. The highway right of way shall be left in
s condition at least equal to its condition before utility work was started.
9. USE OF EXPLOSIVES
No explosives shall be used within limits of highway without written
permission of the Department.
Requests for permission to use explosives shall include the following
information:

a. Locat£on where use of explosives is proposed.
b. Type, amount, t£me o£ day, etc., where use of explosives is proposed.
c. Ha~e and qualifications of person who will be in responsible charge of
blasting operation.
d. Type and amount of insurance coverage for blasting operations. Furnish
name and address of insurance company.
e. Adequate assurance that no damage or hazard will be caused thereby, in-
cluding detailed plans and procedures approved by a person qualified and
experienced in the use of explosives.
10. UTILITY ACCOI~IODATION POLICY
Utility installations on, over or under the right of way of the State
Highway System shall conform with requirements contained in the Texas State
Department of Highways and Public Transportation Utility Accommodation Policy
adopted 3uly, 1974, alonE with curreot revisions thereto, and/or as a minimum,
the appropriate requirements outlined ie the following:
a. Electric power and communication utility installations.
(1) National Electric Safety Code
(2) Safety rules for the installation and maintenance of electric
supply and communication lines - National Electric Safety Code
b. Water lines - American Water Works Association
c. Gas pipelines - Title 49, CFR, Part 192, Transportation of Natural and
Other Gas by Pipeline: Minimum Federal Safety Standards and amendments.
d. Liquid petroleum pipelines - Title 49, CFR, Part 195, Transportation of
Liquids by Pipelines and amendments.
e. Latest American Society for Testing and Materials (ASTM) specifications.

I~IS?I~.TATION OF WATER OR PRESSURE SEWER LINES
WITHIN HIGIi~AY RIGHTS OF WAY
1. LONGITUDINAL INSTALLATION
The pipes shall be placed on uniform alignment and shall be
installed in an area between three (3) and ten (10) feet from the
right of way line. The minimum depth of cover in the right of way
shall be twenty-four (24) inches for metallic pipe and thirty (30)
inches for nonmetallic pipe. If a nor~etallic pipe is to be used,
a durable metal wire shall be concurrently installed with the line
or other means shall be provided for detection purposes. Each pipe
line may be installed with enough vertical flexibility to prevent
excessive stresses; however, horizontal "snaking" of the pipe within
a construction ditch is not approved,

CROSSINGS
The crossing o~ any pavement structure of existing roadways
(including intersecting streets and roadways) within the highway
right of way shall be installed as provided herein:
The crossings shall be encased and shall be placed by borin~
or tunneling. Jacking or pushing of encasement by mechanical
means shall not be used. The construction installation shall
be made in a manner that will not interfere with the operation
of the highway. It shall not weaken or damage any embankment or
structure of the highway. No unprotected excavation under the
pavement structure is allowed in the placement of the casing if
the size of bore, nature of soil, or the cover above the bored
hole is insufficient to prevent cavin~ of the excavation.
The casing shall be approximately the same size as the bored
or tunneled hole. Void spaces resultin~ from more than one (1)
inch free bore after the placement of the casin~ shall be pressure
grouted with a mixture consisting of two (2) sacks of cement per
cubic yard of sand.
Casing shall consist of a pipe or other sepamt~structure
around and outside the carrier line. It shall be designed to
support the loads of the hishway and superimposed loads thereon,
including those of construction machinery. The strength of the
casing shall.equal or exceed the structural requirements for
drainage culverts and shall be composed of materials of satis-
factory durability under conditions to which the casing may be
subjected. A readily identifiable and suitable marker shall be
placed at the right of way line showin~ ownership of the line.
Encasemeut shall, at a minimum, be installed under pavement, normal
center medians, center of ditch to center of ditch for cut sections
(or five feet beyond the toe of slope for fill sections, or face
of curb) on all roadways unless safety distances require greater
lengths.

SPECIFICATIONS FOP. BACKFILL
Trenches shall be backfllled with material selected from the excavation,
or obtained from other sources, which is free from stones of such size
as to interfere with compaction and is free from large lumps which will
not break down readily under compaction. The Department Engineer shall
have the right to reject any material containing more than 20 percent
by weight of material retained on a 3-inch sieve, or material excavated
in such a manner as to produce large lumps not easily broken down or
which cannot be spread in loose layers. In general, material excavated
by means of a trenching machine will meet the requirements above pro-
vided large stones are not present.
The following requirements shall apply to the backfilling of trenches
in addition to the pertinent portions of the general requirements given
in the preceding paragraph.
After the bedding has been prepared and the pipes installed as required
by the pertinent specifications, selected materials from excavation or
borrow shall be placed along both sides of the pipe equally, in uniform
layers not exceeding 6-inches in depth (loose measurement), wetted if
required, and thoroughly compacted so that on each side of the pipe there
shall be a berm of thoroughly compacted material at least as wide as the
external diameter of the pipe, except insofar as undisturbed material
obtrudes into this area.
Filling and/or backfilling shall be continued in ~is manner to the ele-
vation of the top of the pipe. Special care shall be taken to secure
thorough compaction of the materials placed under the haunches of the
pipe. All fill or backfill below the top of pipe shall be compacted
mechanically in the manner prescribed above, regardless of whether such
material is placed within the limits of the embankment or roadbed.
In the case of pipe placed in trenches, that portion of the backfill
above the top of the pipe which supports the embankment or roadbed shall
receive mechanical compaction and shall be placed in 6-inch layers in
depth (loose measurement). The portion which will not support any part
of the embankment or roedbed shall be placed in layers not more than 10-
inches in depth (loose measurement) and shall be compacted by whatever
means the Contractor chooses to a density comparable with the adjacent
undisturbed material, Water Jetting or ponding is not permitted.
Hand operated mechanical tampers may be used with approval of the Engineer
for compacting backfill.
