Re: Escrow Fee for Improvements to Substandard Road Dear Mayor Morton and City Council: It is my understanding that the City of Coppell intends to require the Riverside Church of Christ to pay an escrow fee of $68,412.80 for future paving improvements to Belt Iine Road. This fee was calculated pursuant to the City of Coppell Master Fee Schedule and assessed pursuant to Section 17 (b) of City of Coppeil Subdivision Ordinance No. 341. Section 17 (b) provides that if it is not feasible to reconstruct a substandard road at the time of development of a proposed subdivision which is located along one side of such substandard road, the City Council may permit the developer m pay into escrow its share of said improvements. At the present time a $68,412.80 escrow fee will have a negative impact on the proposed development of the site in question. With a current estimated development cost of $2,900,000, a $68,412.80 escrow fee would amount to an unanticipated expense eqnal to 2% of the entire project budget. The burden of adding this expense to our current budget might hinder or even cancel our plans to develop the site in 1994. Mr. Gary Sieb, Director of Planning & Comm,mity Services, has suggested that we write the City Council regarding a waiver of the escrow fee requirement. It is apparent from the lan~jage of Section 17 (b) that assessing the escrow fee is entirely with in the discretion of this Council. Additionally, it is possible that any furore improvements to Belt line Road may be paid by Dallas County, thereby negating the need for any such fee. Thus, pursuant to the council's discretion under Section 17 Co) of City of Coppell Subdivision Ordinance No. 341 and in consideration of the general policy of the City of Coppell to waive the escrow fee requireme?t where a religious entity is concerned, the Riverside Church of Christ respectfully requests that the escrow fee requirement for future improvements to Belt I Jne Road be waived.
