(ADDRESS), COPPELL, 'p~XAS (THE OWNER) UNDERSTAND AND
ACKNOWLEDGE THAT THE FENCE WHICH IS LOCATED ON THEIR PROPERTY
ENCROACHES ONTO TH~ CITY OF COPPELL ' S DRAINAGE EASFd~ENT;
AND
W~EREAS, THE OWNERS UNDERSTAND AND ACKNOWLEDGE THAT IN CASE
REPAIRS OR IMPROVEMENTS ARE REQUIRED TO BE MADE TO THE CITY OF
COPPELL ' S DRAINAGE EASEMENT WHICH WOULD REQUIRE REMOVAL OF TH~
FENCE I~ ORDER TO EFFECT SUCH IMPROVEMENTS; AND
WHEREAS, THE OWNERS RECOGNIZE AND ACKNOWLEDGE THAT SUCH FENCE
WAS INST~J.RD DESPITE KNOWLEDGE OF THE CITY'S DRAINAGE EASEMENT;
OWNERS HEREBY AGREE TO REMOVE SUCH FENCE AT T~IEIR OWN COST AND
UPON REQUEST BY ~ CITY OF COPPELL, AND IF OWNERS FAIL TO REMOVE
TH~ FENCE UPON REQUEST B~ THE CITY, TH~N CITY WILL REMOVE SUCK
FENCE AND O~]ERS HEREB~ INDEI~NIFY AND HOLD THE CITY HARMLESS FROM
ALL CLAIMS OF DAMAGE TO THE FENCE WHICI~ ARISE FROM TI{E CITY'S
REMOVAL OF SUCI~ FENCE WHILE REPAIRING, INSPECTING, IMPROVING OR IN
AN~ WAY SEEKING ACCESS TO THE DRAINAGE EASEMENT. ADDITIOAL%TJJf,
OWNERS AGREE TO REIMBURSE THE CITY FOR REASONABLE COSTS INCURRED IN
REMOVING 'PPLE FENCE.
