Dear Mr. Griffin:
I am forwarding your request for information to Ms. Sue F. Reid, in the Dallas District office. Ms. Reid handles
these requests for the district. Her staff should be contacting you soon about the cost of the copies and to make
arrangements for you to pick them up.
If the GTE and the City of Coppell can agree to a plan to share the utility accommodation area, without damaging the
trees, TxDOT approval should not present a problem. GTE can get permission from this office to move their line at
stich time as they request to do so, providing they do not do irreparable damage to the root system of the trees. In
some locations, it is has been necessary for these installations to be bored, to avoid killing trees. If they are willing
to move their line, as Mr. Casteel states, there would be no need to meet.
Another option might be for GTE and/or the City of Coppell to replace the trees at another agreeable location on SH
121 Right of Way and maintain them for a period of time necessary to assure survival. If that is an option you feel
you want to pursue. we would need to involve our landscape architect in the process (to determine species,
replacement ratios. and a proper length of maintenance period). Several meetings might be needed.
[ am asking Mr. Nabors to contact you next week about a possible meeting. Since there is some question in my mind
about statements attributed to him and Mr. Rawlings, I would like for them both to be present.

Dear Mr. Elsom:
This letter is written as a follow-up to our telephone conversation of Sept 2, 1999 concerning the installation of
the GTE fiber optic cable along the eastside of S.H. 121 from Sandy Lake north to Copper Rd. As stated, at
various locadous throughout the installation, the cable meanders through the first ten (10) feet of fight-of-way.
TxDOT Permit//19981215060 issued to the City of Coppeil for a 12" water line allows us to install our wa~er
line 10 feet inside the S.H. 121 right-of-way. Howaver, as previously stated, we have encountered a
meandering GTE fiber optic cable at several locations which has prevented us from completing the 12" water
line installation.
Per this letter, I am requesting a copy of the GTE permit along with all accompanying plans and atmchrnents for
the GTE fiber optic cable along the eastside of S.H. I21 from Sandy Lake to Coppell Rd. Also, I would like a
copy of the TxDOT Utility Accommodation Policy dated May 29, 1989 and the Dallas District Utility Policy.
Both of these documents are refi.'renced in our permit as needing to be complied with during the permitted
installation. I will be happy to pick those up at your office at your earliest convenience.
During our conversation you stated you could not require GTE to relocate their cable. Altached to this ]cm~r is a
leuer from GTE dated September 3, 1999, which indicates that they would be willing to relocate their cable.
However, Mr. Rawlings of TxDOT has told them that they will not be allowed to relocate their cable. I am
confused as to what has actually transpired in regard to GTE's fiber optic cable.
At this point it is my recommendation that all parties meet to resolve this issue. The City of Coppell will be
happy to host this meeting. Please let me know at your earliest convenience when you will he able to meet.

permit any work by GTE to be done h~ altering the cable within their ILO.W. Their contention was
and still is that such work would involve heavy machinery disturbing the "drip line" of the existing
oak trees and flow line of the ILO.W. contour.
Since nty last conversation with Hendricks, I have received his letter requesting this cable be
relocated. I am formally advising you that GTE must not relocate, alter or even dig along that state
right-of-way without the express written permission of TXDOT. We can appreciate the importance of
the water line and the completion of this project. If the line is to be placed the apparent options are
either change the mind of the Highway Dept. or adjust your water line, (depth / alignment). GTE
must abide by the decisions and mandates of the State in relation to the roles and guidelines
governing their highway right-of-ways.

In our meeting with you, Mr. Gary Casteel of GTE, and Mr. Larry Davis of the City of Coppell on July 21,
1999, we understood GYE was to proceed with the relocation of the underground communication cable in the
areas in conflict with the proposed City of Coppell water line along State Highway 121 (See the attached
memorandum dated July 30, 1999).
As outlined in the July 30e memorandum, the City of Coppell has a permit from the Texas Department of
Transportation for the construction of this water line within the gtate's right-of-way. The City's water line
was permitted for a distance of 10-feet off the right-of-way line and the project alignment was set using the
state's right-of-way markers and right-of-way strip map (not tic fence lines or tree line). It is very likely that
the permit issued to GTE by Texas Department of Transportation provides for a specific location of your
facility also. We suggest you review the permit and determine if your communication line was constructed in
accordan~ with the permit issued by TxDOT.
As of the date of this letter, Mr. Larry Davis w~th the City of Coppell reports no relocation efforts have been
completed by GTE. Mr. Davis has explained that apparently you are experiencing some difficulties with the
Texas Department of Transportation relative to yo~ ralocation; however, we have received no wriRen
explanation, schedule or request for assistance GTE.
The construction of this 12-inch water ~ransmission main is critical tv the proper operation of the City's water
system and the health, safety and welfare of the public. It is vitally important that this water line be completed
immediately so that the City can provide adequate service and fire protection to developments in this area of
the Ctty. On behalf of the City of Coppell, we request that GTE proceed with all forces, manpower and

State Highway 121 Water Line
A meeting held at the project site of the 121 water line on Wednesday, July 21, 1999 to discuss the conflict
between the GTE underground telephone cable and the proposed 121 water line. In attendance were:

Larry Davis briefly explained the conflict and limits. In general, GTE's existing cable is in the same location
as the proposed water line at various points between water line station 21+00 and station 26+00. In all, Mr.
Davis estimated that no more than 300 linear feet of actual conflict existed between the limits described.
From our observations in the field, it appears GTE's cable was constructed outside the normal 0 to 3 feet from
the State's Right-of-way, possibly due to the location of the existing fence and Wee line in this area. As a
reminder, the State typieal!y reserves the first 10-feet of right-of-way for use by public utilities and normally
the first 3 feet are utilized for placement of utility poles and underground communication lines. The remaining
3- to 10 feet is normally for other public utilities. The City's water line wus permitted for a distance oflO-
feet off the right-of-way line and the project alignment was set using the state's right-of-way markers and
right-of-way strip map (not the fence lines).
Based on this meeting, it was our understanding the GTE will proceed with the relocation of their underground
cable in order to clear the proposed water line. The City ( Mr. Davis) requested that the GTE line be at least 2-
feet horizontal distance away from and 3-feet vertical distance below the water line. Mr. Casteel requested a
set of water line plans and we reminded him he should have a set in his files. If not, he will contact me for
another set which we will promptly provide.
From the meeting, we understand GTE has some issues to resolve with TxDoT concerning trimm'mg of trees
or location of their line under the drip line of trees. Mr. Strange indicated they would work to resolve those
problems.
At this stage, the City's contractor reports he will complete the remainder of the project by the end of this
week (July 23, 1999) and he will be delayed until the GTE conflict is resolved.

Dear Mr. Hendricks:
In regards to your October 19, 1998 letter concerning the two
alignment issues, TXDOT offers the following.
1. TxDOT provides for aerial utilities to be placed in the
first three feet of the right of way. Three to ten feet is
for any underground utility. The Dallas District generally
does not dictate the alignment for any utility. Only that
the alignment must be a set distance uniform with the right
of way line.
2. As far as exceptions to deviate from the ten foot
alignment, TxDOT only considers this option when the first
ten feet is full of utilities and other considerations
warrant such justification.
If the existing fiber lines deviates as indicated in your letter,
the owner of the fiber cable will either have to cor. pletely adjust
the line or more the necessary areas in conflict to prevent the
cable from being cut during the installation of the water line.
At this point, TxDOT does not consider adequate justification
exists to warrant an exception. AS for the existing trees, if the
city is unwilling to remove them, the water line can either be
bored under the trees or placed on easement.

At the request of the City of Coppell, we are submitting this preliminary set of construction plans for the S.H.
121 Water Line project, from Sandy Lake Road to 675 feet south of Corporate Drive. This submittal is being
made in advance the formal Notice of Proposed Installation on Controlled Access Highway (TxDot Form
1082), which the City will submit at a later date. The purpose of this preliminary submittal is to get the state's
determination concerning two alignment issues:
It is our understanding the State' s Utility Accommodation Policy provides for communication facilities to
be installed in the first 3-feet of right-of-way, with water and sewer lines to be installed between first 3 to
10 feet of the fight-of-way. Based on preliminary discussions with your office, we have set the water line
alignment 10-feet inside the existing fight-of-way of S.H. 121. During our field surveys for this project,
we noted a recently installed underground telecommunications line (fiber optic?) meandering up to and
beyond 10-feet inside the existing fight-of-way. The location of the recently installed cable is shown on
our construction plans in accordance with the new trench line we found. We believe this facility is owned
by Co-serve Communications. Is there a Notice of Proposed Installation on file in your office for this
facility and does it provide for a definite alignment? What recourse does the City have if this facility is in
conflict with the Notice requirements you have on file?
The City of Coppell has requested the State consider an alignment exception to the normal Utility
Accommodation Policy for a portion of the proposed water line. Please refer to. The alignment exception
is between water line station 19+80 and 22+39 as marked up on construction plan sheets 3 and 4 and is
made in order to facilitate the construction of the water line across the drainage channel at the outfall of
the 66-inch pipe culvert. The revised alignment will also minimize the removal of trees and ease
maintenance of the water line in the future.

The Texas Department of Transportation (TxDOT) offers no objection to the location on the right-of-
way of your proposed BURIED COMM. line as shown by accompanying drawings and notice dated
08/15~97 except 'as noted below.
Your attention is directed to governing laws, especially to Article 6674w-1, Vernon's Annotated Civil
Statutes of Texas, pertaining to Control of Access. Access for servicing this installation shall be
limited to access via (a) frontage roads where provided, (b) nearby or adjacent public roads or streets,
or (c) trails along or near the highway right-of-way 'lines, connecting only to an intersecting road; from
any one or all of which entry may be made to the outer portion of the highway right-of-way for
normal service and maintenance operations. The Owner's rights of access to the through-traffic
roadways and ramps shall be subject to the same rules and regulations as apply to the general public
except, however, if an emergency situation occurs and usual means of access for normal service
operations will not permit the immediate action required by the Utility Owner in making emergency
repairs as required for the safety and welfare of the public, the Utility Owner shall havst a temporary
right of access to and from the through-traffic roadways and ramps as necessary to accomplish the
required emergency repairs, provided the TxDOT is immediately notified by the Utility Owner when
such repairs are initiated and adequate provision is made by the Utility Owner for convenience and
safety of highway traffic.
It is expressly understood that the T~DOT does not purport, hereby, to grant any right, claim, title, or
easement in or upon this highway; and it is further understood that the TxDOT may require the owner
to relocate this line, subject to provisions of governing laws, by giving thirty (30) d~ys written notice.
You are requested to notify this office prior to commencement of any routine of periodic maintenance
which requires pruning of trees within the highway right-of- way, so that we may provide
specification~ for the extent and methods to govern in trimming, topping, tree balance, type of cuts,
painting cuts and clean up. These specifications are intended to preserve our considerable
investment in highway planting and beautification, by reducing damage due to trimming.
The installation shall not damage any part of the highway and adequate provisions must be made to
cause minimum inconvenience to traffic and adjacent property owners. In the event the Owner fails
to comply with the requirements as set forth herein, the State may take such action as it deems
appropriate to compel compliance.
