Dear Mr. Jackson:
My clients and the United States Government have approved the
proposed settlement in this case on or about December 20, 1989.
It is my understanding that your client will pay to First
Gibraltar Bank, FSB, as successor in interest to First Texas
Savings, and Terra Land Development Co. the sum of $36,000.00 upon
my execution of an order of dismissal in the above-referenced
matter on behalf of my clients.
I would appreciate it if you would send to me the order of
dismissal which you would like me to approve on behalf of my
clients and your client's check for $36,000.00 made payable only
to First Gibraltar Bank, FSB and Terra Land Development Co. I
will execute and return the order of dismissal to you and I will
not release the check to my clients until I have done so.
