I am in reeeipt of your letter of May 30 eoneerning the list of eosts and expenses
your client attributes to the above mentioned condemnation action. When we met at
the courthouse, I requested that your client furnish us with a detailed breakdown of
the costs alleged to have been incurred in this matter. The very general listing in
your letter of May 30 is not sufficient for us to determine the reasonableness or
necessity of the total amounts listed. Riverehase is asking the City to reimburse it
by agreement for its expenses. To consider this request, the City will need a more
detailed itemized statement concerning each of the categories listed in your letter.
We would hope to get this information from your client voluntarily without the
necessity of incurring the additional expense that would be involved in making the
request through the court. Also, we do not feel that our client should be responsible
for any additional costs if we are required to obtain this specific information by
interrogatories and request for production.
What we had here was a hearing before the commissioners which involved one
afternoon session followed by your filing an objection to the commissioners award.
Based upon what was presented at this hearing, it is inconceivable to us that your
client's costs could be $49,253.00. Before agreeing to pay this amount, our client
certainly is entitled to a very detailed explaination as to all of the costs involved
which will support the fact such costs were both reasonable and necessary.
