Dear Larry:
Pursuant to our conversation at the courthouse after the
Motion to Reinstate the above-referenced lawsuit was granted, I am
writing to let you know the current status of the claim for
attorneys' fees and expenses which my clients have incurred in
defending the above-referenced matter. To the date of this letter,
the attorneys' fees approximate Thirty-Six Thousand Dollars
($36,000), engineering fees of Six Thousand Three Hundred and Eight
Dollars ($6,308), appraisal fees of Five Thousand Five Hundred and
Fifty Dollars ($5,550), and miscellaneous expenses for photographs,
artist renderings, exhibits, etc. of One Thousand Three Hundred and
Ninety-Five Dollars ($1,395). This totals Forty-Nine Thousand Two
Hundred and Fifty-Three Dollars ($49,253) which does not include
any attorneys' fees to pursue the claim from this point forward.
I would appreciate your discussing this matter with your
client, and getting back to me by June 15, 1989 with some
indication as to whether or not your client is agreeable to
reimbursing my clients' expenses and dismissal of this lawsuit
without any further expenditure of time and money by my clients.
