Dear Sir:
You have requested permission to construct a drainage channel within
the hounds of Texas Power & Light's right of way strip we hold by
easement as now of records in Volume 8S077, Page 3300, Deed Records of
Dallas County, Texas.
This is to advise that Texas Power & Light is agreeable to the
construction of the drainage channel if the facility is located as
shown on the attached print, marked Exhibit "A," and upon the
following conditions:
That you agree to indemnify and hold harmless Texas Power &
Light from claims or damages asserted by any person against
Texas Power & Light, arising out of the construction and
maintenance of the drainage channel, unless caused solely
by negligence of Texas POwer & Light.
No boom-type equipment shall be used~in COnnection with any
work to be performed by you, your emDloyees or contractors,
unless special arrangements are made with Texas Power &
Light's Supervisor of Transmission in Irving, Mr. Hark
Carpenter, telephone no. 214/721-8200.
At all times you will maintain adequate clearance from our
electrical lines in order that no injury or damage will be
caused to persons or property.
It is understood and agreed that Texas POwer & Light only
holds easement rights on the property involved; therefore
you will be required to obtain whatever rights, other than
Texas Power & Light's that are necessary.

5. This agreement will be binding upon you and your heirs and
assigns as a Covenant running with the land.
6. That Texas Power & Light reserves the right to build future
overhead transmission and underground and Overhead
distribution lines along this right of way as deemed
necessary in the future.
7. Any lighting that may be installed will have to be approved
by Texas Power & Light.
8. That no trash dumpsters will be kept on the right of way.
9. That Texas Power & Light will not be responsible for damage
to the drainage channel.
10. If signed letter agreement is not received within sixty
(60) days of date of letter, this agreement will be
considered null and void.
If you are willing to accept this conveyance on these terms, please
note your approval below, have signature properly notarized with
notary seal affixed and return the original to The Real Estate & Right
of Way Division, Texas Power & Light, Room 1412, P.O. Box 660288,
Dallas, Texas 75266-0268.
