December 19, 1994 Mr. Richard Crow 3811 Turtle Creek, Suite 1020 Dallas, Texas 75219 RE: Roadway Impact Fees Dear Mr. Crow: This letter is in response to an inquiry concerning the City's proposed adoption of Roadway Impact Fees. As you may be aware, the City Council will be considering the adoption of Roadway Impact Fees at the January 10, 1995 City Council meeting. The City Attorney, with the assistance of City staff, is preparing an ordinance amending Chapter 17 of the Code of Ordinances to add Roadway Impact Fees. Several complex issues will be addressed in the Roadway Impact Fee Ordinance. These include the following: 1. A system for offsets and/or credits toward right-of-way dedication and/or roadways that have been constructed by developers; 2. A comparison between the City's current escrow fees and the proposed Roadway Impact Fees for projects currently in the development process and the collection of the lesser amount. As you can see, both of the above offer a great amount of latitude and flexibility to developers currently in the development process. The City has not determined what is to be considered "in the development process" i.e., does the process start on the application date or the preliminary plat approval date? Those issues will be resolved when Council takes action on the ordinance. When the preliminary ordinance has been prepared by the City Attorney, a copy can be faxed to your office, upon request, for your review prior to the January 10th City Council meeting. As always, the City is very sensitive to the needs of the development community. The Council will make every attempt to be fair in the adoption and implementation of any ordinances that affect the development community.
