Box 478 Coppell, TX 75019 RE: City of Coppell Roadway Impact Fee Study (JBM Project No. 93-520) Dear Mr. Griffin: Forwarded herewith for your information and use is an outline of "Procedures for Adoption of Roadway Impact Fee" as required by Chapter 395, Texas Local Government Code (S.B. No. 336). Also included is a report on Land Use Assumptions for Roadway Impact Fees developed in coordination with Gary Sieb, City Planner. The report includes the service area map, projections of changes in land uses, densities, intensities and populations for the base year 1994, ten year projections (2004) and build-out. This data has been provided to Gary Sieb for review by the Advisory Committee (P&Z). It is our understanding that Gary wants to set the public hearing for land use assumptions for August 18th. This will require that the Council pass a resolution to publish notice of the hearing at least 30 days prior to that date. The Council is required to adopt a resolution within 30 days after the hearing on the land use assumptions. After City Council approval of land use assumptions, we will proceed to finalize the roadway Capital Improvements Plan. If you have any questions regarding this information, please advise me. P E J. . ry,,,.~. \ Project Manager cc: Mr. Gary Sieb, City of Coppell Barbra Leftwich JWB: apn PROCEDURES FOR ADOPTION OF ROADWAY IMPACT FEE CHAPTER 395, TEXAS LOCAL GOVERNMENT CODE Ao Hearing on Land Use Assumptions The City must adopt an order, ordinance or resolution establishing a public hearing date to consider land use assumptions within the service area that will be used to develop the C.I.P. The City shall appoint a Capital Improvements Advisory Committee (May be P & Z Commission) on before day heating date is established. o On or before the date of the first publication of the notice of public hearing, the "land use assumptions,' time period for projections, and nature of capital improvements proposed must be made available to the public, wi_and use assumptions" includes a description of the service area and projections of changes in land uses, densities, intensities, and population there in over at least a 10 year period. The City shall provide public notice: a. 30 days before the hearing, send a notice of the hearing by certified mail to any person who has given written notice by certified or registered mail to City secretary or other designated official, requesting notice of such heating within two years proceeding the date of adoption of resolution setting the public hearing. bo The City shall publish notice of the hearing once a week for three (3) consecutive weeks, the first notice to appear at least 30, but not more than 60 days before the date set for the hearing, in one or more newspapers with general circulation in each county in which the political subdivision lies. The notice of public heating shall not be in the part of the paper in which legal notices and classified ads appear and shall not be smaller than one-quarter page of a standard-size or tabloid-size newspaper, and the headline on the notice must be in 18-point or large type. The notice shall contain the following: (A) A headline to read as follows: "Notice of Public Hearing on Land Use Assumptions Relating to Possible Adoption of Impact Fees." 03) The time, date and location of the heating. (c) A statement that the purpose of the heating is to consider the land use assumption that .will be used to develop a capital improvements plan pursuant to which an impact fee may be imposed. CD) An easily understood map of the service area to which the land use assumptions apply. (E) A statement that any member of the public has the right to appear at the hearing and present evidence for or against the land use assumptions. The City will have 30 days from the date of the heating within which to adopt an order, ordinances or resolution approving the land use assumptions. If the City approves land use assumptions, a capital improvements plan will be developed, after which a public hearing must be held by the City to discuss the proposed adoption of the C.I.P. and imposing an impact fee. Procedures for establishing a public heating are similar to that for the land use assumptions heating.
