Gary Sieb confirmed to me yesterday that they (Planning & Zoning)
will handle the attached item. We will review and comment (if any)
and track it to completion.
The next check date will be Wednesday, December 13, 1989, the day
after the next City Council meeting.

Gary, I have reviewed the above referenced memorandum and
generally concur with your perspective on this matter. I was
unaware that the Planning & Zoning Coordinator was preparing
this type of document and since receipt of the memorandum have
discussed the matter with Russell Doyle, City Engineer.
Engineering will prepare such documents in the future, and
will document to Planning & Zoning where appropriate in order
that staff and City Council will be aware of such issues.
Additionally, several programs are being planned for Engineering
and the revamping of some operational procedures resulting
from the restructure October 1. Should ~ou become aware of
other areas which you believe are similar to this matter, please
let me know.

PRO-RATA ]~GREEMENT FOR SUBDIVISIONS
Steve, in conversation with Taryon, I have been advised that Planning has
been preparing the pro-rata water agreements for subdivisions. That
activity strikes me as being a bit puzzling, as pro-rata instruments are
traditionally municipal engineering department driven. In further
conversation with Taryun, I understand that Enssell had assigned her that
responsibility when he acted as her supervisor, and over ti~e Planning has
continued to write these agreements.
I am a bit uncomfortable with that procedure for a n-mher of reasons, not
the least of which is the fact that neither Taryon or me are P.E.'s, end
we are dealing with some technical engineering data. Secondly, it is my
understanding that Public Works is the department of record of pro-rata
charges, which suggests that Public Works would call the shots on all
pro-rata activity, including ordinance preparation.
At any rate, I am enclosing a draft copy of Shadowridge Estates, Phase IV
pro-rata agreement, which was written by Ta~yon. It is my understanding
that a request to draft this ordinance was sub~itted to Larry Jackson.
Subsequent to that request, I have been told, Hr. Ratliff instructed Larry
to not draft this agreement end further advised him that City staff
~ould prepare these instrt~aents in the future. We have complied with Hr.
Ratliff's wishes and fo~arded a copy of the attachment to Larry for legal
review.
In the future, I ~ould hope that Engineering would ansu~e this
responsibility because of the Department's knowledge, familiarity, and
expertise in this area. Do you have any problems with Engineering
assuming this responsibility?
