Based on input from that meeting, the City is proceeding with the bidding of this project. It is anticipated that the contract will be awarded for the project in either November or December, depending on the actual opening of the bids. To facilitate the construction of this project, it is necessary to obtain an additional drainage easement off of your property. Included with this letter is a copy of the drainage easement. This easement should be signed, notarized and returned to the City. For your convenience, the Engineering Secretary is a notary and will be happy to notarize your signature prior to the submittal of the easement. Also, included with this letter is a portion of the construction plans showing the type of improvements and/or grading that will be placed on your property in the drainage easement. This project is currently on a fast track and any assistance you can provide the City in expediently signing and returning the easement will be greatly appreciated. Said easement being described in Exhibits "A" and "B" attached hereto and made a part hereof for all purposes. That in consideration of the benefits above set out, GRANTEE will remove from the easement, such fences, buildings and other obstructions as may be found upon said property. After construction of the drainage improvements has been completed, GRANTEE shall, except for removed obstructions, return the surface area of the easement to its original condition as nearly as practical taking into consideration the nature of the work being performed. GRANTORS reserve the right to use and maintain the surface of the easement for purposes which will not interfere with GRANTEE'S rights hereby granted and agree that upon completion of the drainage improvements and restoration of the surface, GRANTEE shall not be obligated for future maintenance and upkeep of the surface area.
