On June 16, 1993, I met with Ron Robertson, at 622 Meadowview, concerning the
encroachment of a proposed swimming pool into a drainage easement. After discussing the
potential problem with Mr. Robertson, the thought process and the solution arrived at was as
follows:
Based on the Albert Halff Drainage Study, the ultimate 100 Year Water Surface in this
area is at an elevation of approximately 484. Using that elevation, I referred to our 1992
Aerial Maps and noted where 484 generally fell on the lot. Based on the location of the
current drainage easement and the approximate location of the 484 elevation, it appears
as though approximately 18 to 20 feet can be taken out of the drainage easement. I
informed Mr. Robertson that I could support removing a portion of the drainage
easement based on the Albert Halff Study, but to accomplish it would take a replat of the
lot. The replat fees could be in the range of approximately $500 and the process could
take approximately 60 days.
I told Mr. Robertson that to accurately determine the 484 elevation on the replat, a surveyor
should survey the ground to ascertain where the 484 elevation actually falls on the lot. The
location of the 484 elevation should then be transposed to the replat as the new drainage
easement. Mr. Robertson stated he had no problems with that procedure and was pleased that
there was a solution to the problem.
The solution to the encroachment into the drainage easement is a similar solution that has
recently been offered to developers of the Big Cedar and Country Estates Subdivisions.
