Public Works/City~ngineer RE: Discussion and consideration of awarding Bid # Q 1094-01 Stream G-6/Bethel School Road Drainage Improvement Project # DR 93-06 to M.A. Vinson in the amount of $213,188.08 and authorizing the Mayor to sign. Date: October 31, 1994 As directed by City Council, the drainage improvements to Stream G6 have been designed by O'brien Engineering. The specifications were prepared by the City of Coppell Engineering Department. Five bids were received and opened on October 31st, 1994. The Engineer's estimate was $158,000 and the low bid was $213,188.08. Staff has evaluated the credentials of the low bidder and it is our opinion that the bidder is capable of performing the work necessary to complete the project. In evaluating the disparity between the Engineers estimate and the low bid, it is my opinion that the difference is caused by the complexity of working in the channel. The City has stressed that additional precautions should be taken to ensure that no damage is caused to the adjacent property. The main price difference is in items 7, 8, 9 and 10. These are the main items that deal with the channel work. Also, because of recent erosion associated with the heavy rains, it is anticipated that a change order will be brought forth at the December Council meeting that would deal with the way the gabions are attached to the channel. As City Council may be aware, the proposed project is a project from our City Wide Storm Water Management Study as adopted by the City in 1991. I have included a copy of Plate 3.3 which shows this project. Also, included with this agenda item is a copy of the Phase 2 implementation plan. As can be seen, Stream G-6 was the first project in the Phase 2 implementation. Also, included with this agenda item is a portion of Appendix C, from the Storm Water Management Study, which deals with the complaints received in 1989 from residents that lived along Stream G6. The date all the complaints were received was July 3, 1989. I was not employed here at that time so I am unsure if there was a particular storm event that caused the residents to call or if the residents, as a home owners group, got together and decided to telephone the City to request that something be done to Stream G6. Because of the response from the residents, improvements to Stream G6 received a high priority in the overall plan. There have been two public meetings with the residents that live along Stream G6. At the second public meeting, it was my understanding that there was support for the project. Not everyone was pleased but as a group they expressed support. The main concern was loss of trees and the fact that after a few rains the creek would return to its preconstruction state. I tried to make it very clear that this was a one time attempt by the City to resolve the standing water issue. However, the adjacent property owners would have to assume some responsibility for maintenance to ensure that the channel stayed in place. After the meeting, I was contacted by Jesse Youngker, of 626 Meadowview, requesting that I terminate the project. I was somewhat surprised but I did once again reevaluate the design. Because Mr. Youngker was losing more trees than anyone else, it was decided to end the project before it reached his property. This did not satisfy Mr. Youngker and he has since submitted a petition urging the City to abandon the project (copy attached). Of the 24 homes adjacent to this project, 6 signed the petition to abandon the project and 2 signed the petition requesting that the City yet again revise the project. The signatures are in a checkerboard fashion so the City cannot just chop off even more of the project to try to appease the people against the project. It should be noted that some of the people who did not sign have standing or stagnate water problems. The City has three options: 1) Recognize the petition and abandon the project. (This does not solve nor make the problem go away.) 2) Award the project as designed. (This solves the problem, however, without proper homeowner maintenance some of the problems may reappear. Also, it is doubtful that we would be able to please the people that are opposed to the project during construction.) 3) Award just the concrete channel, gabions, box culvert and down stream grading. This would cost about $130,000.00. (It would solve the flooding problem at Bethel School, however, it would not address the nuisance drainage problems of which I have received the most complaints.) Staff recommends approval of the project as designed and the award of this contract to M.A. Vinson in the amount of $213,188.08. Staff will be available to answer any questions concerning this issue at the Council meeting. July 14, 1989. Phases 1 and 2 represent over one million dollars in improvements to the drainage system~ within the City of CoppeR. The majority of these projects may be funded with the previously approved drainage improvement funds included in the 1990 bond package. However, sources of additional funding I should be pursued by city stafl~ Projects such as Fieldcrest Loop, Kaye Street (south) and Cozby Circle should I be funded at least in part by the property owners with city staff taking the lead in coordination and construction supervision. For example, the Cozby Circle drainage improvements on the individual lots could be funded either by the home owner or by the developer of the Cooper Road lots while the City funds the design and construction of the connection into the existing storm sewer inlet on Anderson Avenue. Other projects, such as, the Sandy Knoll/Woodhurst subgrade failure and the Andrew Brown Park Spillway should be funded under street repair and Parks and Recreation funds, respectively.
