ACKNOWLEDGE THAT THE FENCE WHICH IS LOCATED ON THEIR PROPER~"f
ENCROACHES ONTO THE CITY OF COPPELL ' S DRA/NAGE EASEMENT;
AND
WHEREAS, THE OWNERS UNDERSTAND AND ACKNOWLEDGE THAT IN CASE
REPAIRS OR IMPROVEM]~NT$ ARE REQUIRED TO BE MADE TO THE CIT~ OF
COPPELL'S DRAINAGE EASEMENT WHICH WOULD REQUIRE REMOVAL OF THE
FENCE IN ORDER TO EFFECT SUCH IMPROVF24~NTS; AND
W~REAS, THE OWNERS RECOGNIZE AND ACKNOWLEDGE THAT SUCH FENCE
WAS INSTA~'?'~'D DESPITE KNOWLEDGE OF THE CITY'S DRAINAGE EASEMENT;
OWNERS H~REB¥ AGREE TO REMOVE SUCH FENCE AT THEIR OWN COST AND
UPON REQUEST BY THE CIT~ OF COPPELL, AND IF OWNERS FAIL TO REMOVE
THE FENC~ UPON REQUEST B! THE CITer, THEN CITX WILL REMOVE SUCH
FENCE AND OWNERS MEREB][ INDEMNIF~ AND HOLD THE CIT~ HARMLESS FROM
ALL CLAIMS OF DAMAGE TO T~ FENCE WHICH ARISE FROM THE CITY'S
REMOVAL OF SUCH FENCE WHILE REPAIRING, INSPECTING, IM!~R0VING OR IN
AR-Y WA][ SEEKING ACCESS TO THE DRAINAGE EASEMENT. ADDITIONi~I.?.][,
OWNERS AGREE TO REIMBURSE THE CIT][ FOR REASONABLE COSTS INCURRED IN
