Box 478 Coppell, Texas 75019 214-462-O022 August 8, 1994 Mr. Ed Tool Grand Homes Inc. 8800 North Central, Suite 330 Dallas, Texas 75231 Re: Outstanding Development F~Pha Dear Mr. Tool: This letter is written as a follow-up to my July 5, 1994 letter and a follow-up to our meeting which was also attended by our respective attorneys concerning the fees due and payable. Subsequent to that meeting, you issued a check in the amoum of $12,811.52 which was the outstanding fees for parks, street signs, street cut, inspection and floodplain review associated with Villages of Coppell Phases III and IV. The only outstanding fees remaining on this project are the water and wastewater impact fees. Upon consultation with my attorney and review of the Capital Improvement Program as presented in the Impact Fee Studies for May, 1990 and July, 1991, it is the City's opinion that the wastewater impact fee should be paid at the rate of $225 per equivalent service unit. This is based on the fact that the common project to the entire City in both studies is the TRA central plant expansion at an estimated cost of $3,177,812. The same dollar amount was assigned to this project in both studies. Because the studies are approximately one year apart and the City chose not to assess the maximum amount due and payable under the July, 1991 study in which the Municipal Utility District contribution was broken out as a separate entity, it is the City's opinion that the amount of $225 is a fair and accurate amount to be paid for the wastewater impact fee for these developments. In regard to the water impact fee, it is still the City's opinion that it should be paid at a rate of $660 per equivalent service unit. This is the fee that was in place at the time of the platting of this property. The Municipal Utility District was not involved in our water system at that time and any impact fee was for the city wide system. It is my hope that we can bring this on-going fee issue to a resolution as soon as possible. Please note on the attached chart that a credit has been provided for overpayment of fees associated with Phase II. I recalculated the fees and based on the fees at the time of platting and the fact that the number of lots was reduced from 84 to 62, you are correct in stating that you should have received a credit of $11,330.00. Again, please note that that credit has been shown on the attached chart. Therefore, to bring the issue of fees to a resolution, please provide a check in the amount of $91,795.00 to the City of Coppell and forward it to Alan Johnson, Finance Director, along with a copy of the Fee Assessment List.
