Villages C P3&4-CN 930823HOLD HARMLESS AGREEMENT WHEREAS, THE OWNER OF LOT 18 ,, BLOCK A VILLAGES OF COPPELL SUBDIVISION, PHASE III B (ADDRESS), COPPELL, T~XAS (THE OWNER) UNDERSTAND'A/~D ACKNOWLEDGE THAT THE FENCE WHICH IS LOCATED ON THEIR PROPERT~ ENCROACHES ONTO THE CIT~ OF COPPELL ' S DRAINAGE EASEMENT; WHEREAS, THE OWNERS UNDERSTAND AND ACKNOWLEDGE THAT IN CASE REPAIRS OR IMI~ROVEMENTS ARE REQUIRED TO BE MADE TO THE CIT~ OF COPPELL'S DRAINAGE EASEMENT WHICH WOULD REQUIRE REMOVAL OF THE FENCE IN ORDER TO EFFECT SUCH I~PROVEMENTS; AND W~u~RF~AS, THE OWNERS RECOGNIZE AND ACKNOWLEDGE THAT SUCH FENCE WAS INSTAT-T'~'D DESPITE KNOWLEDGE OF THE CITY'S DRAINAGE EASEMENT; OWNERS HEREBY AGREE TO REMOVE SUCH FENCE AT THEIR OWN COST AND UPON REQUEST B]~ THE CITY OF COPPELL, AND IF OWNERS FAIL TO REMOVE THE FENCE UPON REQUEST B! THE CITY, THEN CITY WILL REMOVE SUCH FENCE AND OWNERS HEREBY INDEMNIF~ AND HOLD THE CIT~ HARMLESS FROM A!.?.
