Re: Tree in Alley Right-Of-Way - Wynnpage Addition
Dear Ms. Musser:
The Public Works staff recently performed an alley survey in the Wynnpage
Addition. During this survey, it was noted that there is a tree in the alley
right-of-way directly behind your property that overhangs toward your property.
This tree grows within the fence line and the right-of-way of the alley and does
pose a hazard. In addition, it was noted that the limbs from this tree are
supporting a tree house in your back yard. This adds additional concern. If the
tree were to fall while someone was in the tree house, this individual as well
as anyone on the ground, could be hurt. We are concerned that this tree could
fall within the public right-of-way and cause damage to a passing vehicle, injury
to a passing pedestrian, or anyone in the tree house.
In this regard, we respectfully request that you remove the tree house within the
next five (5) business days. The overall safety of the public as well as the
children that may play in the tree house is our overriding concern. Public Works
staff will be working with the Wynnpage Homeowners Association in the removal of
any limbs that could be potentially hazardous. Although the city has the
latitude to remove obstructions in public rights-of-way, it is our policy to
inform any affected parties and give them the opportunity to take the action
necessary to correct the problem. Staff wishes to have the tree remain if
possible. A thorough inspection of the tree after the removal of the tree house
and limbs will determine whether or not the removal of the tree will be
necessary.
