ENCROACHES ONTO THE CITY OF COPPELL'S DRAINAGE EASEMENT;
WHEREAS, ~"%IE O¥~NERS UNDERSTAND AND ACKNOWLEDGE THAT IN CASE
REPAIRS OR IMPROVEMENTS ARE REQUIRED TO BE i~ADE TO '~'n~ CITY OF
COPPELL'S DRAINAGE EASEMENT WHICH WOULD REQUIRE REMOVAL OF THE
FENCE IN ORDER TO EFFECT SUCH IMPRO~NTS; AND
WI4~RY~AS, THE OWNERS RECOGNIZE ANDACKNOWLEDGE THAT SUCH FENCE
WAS INSTA~.~.ED DESPITE EI~OWLEDGE OF THE CITY'S DRAINAGE EASEMENT;
OWNERS EEREBT AGREE TO REMOVE SUCH FENCE AT 'l'n~IR OWN COST AND
UPON REQUEST BT TIiE CITY OF COPPELL, AND IF OWNERS FAIL TO REMOVE
THE FENCE UPON REQUEST BT TEE CITY, '~'n~N CITY WILL REMOVE SUCH
FENCE AND OWNERS HEREBY INDEMNIFY ~ HOLD Tn~ CITY EARMLESS FROM
