Concerning item "M' that was on the agenda last night I believe that there was some
confusion as to the previous fax that I had sent to Run. Al~ough what I Wanted to occur,
happened it didn't happen for the reason I asked. I wanted the ditch concern to be
postponed a lnonth or so to consider the following.
This easement area is in the actual property bounds of 6 ~resident in Shadowrtdge. 20'
of 22' of the easement is our concern. The remaining po ~rflon is in Devonshire. I would
like to go through the history of how this ditch came to be and what has been done and
not done over the years. For the sake of this fax I will stick to my request
I wanted Ken Griffin\staff to determine the cost of enclosing the easemlent entirely with
pipe. This pipe would be covered over and we would m~ntain the grass or incorporate
it into our yards. I have never heard what the COSt would be. Yes there ar e concerns from
my neighbors as to having to move landscaping, sprinklers etc. these cost may be minimal
when considering the fact that us homeowners will have to maintain this { aaement forever
as we did once try to establish a homeowners association, but it proved too difficult.
If the city would have incorporated the dish area into Devonshire :onstructton we
perhaps could have had this done in one shot.
Although my neighbors agree only tacidly we would be W~ lling to have ia levy Or tax on
our properties that go on forever to help defray the cost. I have made th,e suggestion that
on the steep yards we could pipe in easily and then in the one low spot perhaps have an
open area with gunite\concrete runway. I findcrstand that you hav~ busy jobs and
probably won't get a chance to see the ditch personally.but I get to mow, clean and
maintain the ditch for a long time. I also have liability responsibility for this eaten3, ent area
as it is within my property boundaries. If a child rides a skate board in this concrete lined
ditch and cracks his skull, I am sure that the parent~ attorney will sue the city and ME~
To give you an. idea on this ditch it will be !,000' long, 1-3' high bani ed vr~l!s and 3'
across the bottom. Roller Blade Heaven!!
Again, please consider thc option of enclosing:this system scad resolving m issue that has
been ongoing now for 6 years. Thanks for your support of this fax and mt ich appreciation
for tile effort that you folks put into this city.
