Dear Mr. Griffin:
I am following up on the status of the easement property behind my home at 201
Magnolia Drive. I have heard that several proposals are being considered to resolve the
ditch matter. Would you please update me as to where we stand, how this matter is
progressing and when we can expect a resolution.
I understand that an option is to concrete in the easement area. This readdresses a
question that I have never had answered. If the ditch is lined with concrete, who is
responsible if kids ride their bikes, skateboard or just walk on the concrete and an
accident occurs? I am of the understanding that I am responsible should someone get
hurt in the easement area. Second, if someone writes/paints graffiti in the ditch, will !
have to clean up the words or spray over it? I would appreciate you contacting the City
Attorney to determine who is ultimately responsible for this area and what can be done
to limit our exposure.
I also understand that an enclosed system has been considered and I favor this system.
It would allow me to enclose the area and make mowing far easier. Also, by enclosing
the area I can minimize my exposure to lawsuits. I understand that there are some
problems to overcome within an enclosed system. If a worse case scenario comes
about, I would hope that my area would at least be enclosed due to the steep nature of
the ditch behind my home. As far as water runoff from our yards, I find this of little
concern as I want as much water as possible to slowly runoff so I don't have to water my
lawn. As in the case of my neighbor and I, one inlet at our property line will suffice.
I am looking forward to your response on this matter as it has been an ongoing concern
for several years now. I understand that you are frying a "big fish" with this pole matter
on Sandy Lake Road; however, I hope you can continue to resolve this matter soon. My
neighbors across the ditch (in Devonshire) blame us for the unsightly ditch and although
I can sympathize with them, I am tired of the ditch being my problem. The ditch was not
there when we bought our home and it was "inherited" and we are doing the best we can.
