Dear Mr. Price:
This letter is written in response to your question concerning floodplain reclamation at 196 State Road in
Coppell, Texas. You and I have discussed the floodplain reclamation at this location several times. It is also
my understanding that you have discussed the floodplain reclamation of this site with one of my staff
members, Keith Marvin.
Regardless of what a Federal Emergency Management Agency (FEMA) representative has said the City of
Coppell's Floodplain Management Ordinance requires a detailed technical study to show the impact both
upstream and downstream of any floodplain reclamation. The City does not allow any fill within a floodplain
without this study. This requirement is covered in Article '4', Section 'C' of the Floodplain Management
Ordinance #2001-952. Once the detailed technical study has been submitted, it is then processed to our
consultant for review to insure compliance with the City's Floodplain Management Ordinance. Once it is in
compliance with the City's Floodplain Management Ordinance, it is then processed to FEMA so that a
Conditional Letter of Map Revision (CLOMR) can be issued. Once that CLOMR has been issued, then the
applicant can approach the City and a Floodplain Development Permit can be issued by the City.
Once the reclamation has been completed then a follow-up study is prepared verifying that all fill was placed
as per the orig/nal study. The follow-up study is then processed back to FEMA so that a LOMR can be
issued, removing the property from the floodplain. Without this process~ no Ifil can be placed in the
floodplain. The City does not allow any fill or encroachment of the floodplain without the detailed technical
study and the CLOMR issued by FEMA.
This is consistent with our prior conversations; however, if you should have any questions please feel free to
contact me at your convenience. If not, we look forward to having a detailed study submitted in the future
concerning the reclamation of this site.
