The only item of work under this contract not completed is the
Bermuda Grass in Medians Item No. 9 under Paving Improvements.
Several weeks ago, L. H. Lacy reported their intent to reseed the
parkways and medians adjacent to the constructed streets with a
mixture of bermuda and rye grass. The rye grass has developed to
varying degrees in the seeded areas.
L. H. Lacy is requesting a reduction in the contract retainage
from 54 to 2%, based on payment for all items with the exception
of the Bermuda Grass in Medians. If you agree to reduce the
retainage to 24, the following amounts will continue to be
withheld.

The total amount withheld, $9,780.02, will probably be sufficient
to cover costs for seeding and developing a bermuda grass cover
if L. H. Lacy failed to follow through with their obligation to
provide bermuda grass. However, Lacy has assured me that once
the weather gets warmer, they will implement measures and achieve
cover of bermuda grass in the seeded areas.

Based on the above, reduction of the retainage from 5~ to 2~ is
recommended. If the total of payments received to date reported
on the contractors request is correct ($243,060.08), then the
current amount due is $4,430.96.
