Modification of Tributary G-1 Downstream of Bethel Road West

Dear Mr. Laterza:
The deed restriction of the stream mitigation area required under condition 2 of the
permit letter for the modification of Tributary G-I has been delayed due to ongoing
negotiations by the City of Coppell to acquire the property necessary to construct
the channel modifications. The City is working to acquire the land required outfight
rather than as a drainage easement. They have met with the two remaining property
owners with whom contracts are needed and are continuing to negotiate a land swap
with one owner and an outright purchase from the second.
The schedule for the Bethel Road West project has been delayed due to coordination
efforts between the City of Coppell and the City of Grapevine on construction of the
project and the fact that the other main route into town (Sandy Lake Road) is under
construction tmtil November 2006. Cun~nt schedule for the Bethel Road West
project includes advertising for bids in July 2006. Submitted below in Table I is an
updated timeline and schedule for the Bethel Road West project.

The City wishes to request a modification to condition 2 of the permit letter so that a
draft deed restriction is required to be submitted to the JUSACE for review and
approval, and the recording of the USACE approved deed restriction with the
County Clerk is completed prior to commencement of any ground-disturbing
activity within the jurisdictional reach of the waters of the United States. Based on
the current anticipated schedule, submittal of the draft deed reslxiction to the
USACE for review and approval should be possible by July 1, 2006.
