Please note that the abandonment is separated into two legal descriptions. The first is for a twenty foot strip to be deeded back to Mrs. Ruby McDowell. Please note that the staff has requested that this acreage remain within a dedicated utility easement. Therefore the abandonment documents should reflect this fact. The second legal description is for a fifteen foot strip to be abandoned to Matthews Investments Southwest, Inc. The additional utility easement for this portion is already included on the proposed Final Plat for Big Cedar and therefore will not require addressing during the abandonment. It is our understanding that the City Attorney will prepare the legal documentation necessary to accomplish the desired goals. We have provided the necessary legal descriptions as enclosed.
