required for the performance of the following described work in connection with construction or improvements at:

The work is to be performed as follows:
NORTHBOUND FREEPORT PARKWAY REPAIRS
NB #1: CONCRETE PAVEMENT REPAIR -8" 6 SACK 4000 PSI 19,012 Square Feet —
Excavate failed pavement to a depth of 14" Install six inches of cement treated base (m) as specified into onsite
material. Process and compact to ninety-five percent (95 %) standard proctor density Fine -grade for paving.. Construct
thickened ends (per attached repair section details) where necessary on the edges of repair slabs to enhance load - carrying
capacity Place 8" concrete with a broom finish. Reinforce with #3 rebar at 24" on center Concrete shall be 4000 PSI, 6
sacks of cement per cubic yard, with air entrainment for durability and resistance to surface scaling. Cure concrete with a
liquid membrane curing compound to insure strength development. Sawcut control joints as necessary Repairs to be
barricaded to vehicle traffic for a minimum of 72 hours.

Payment for all work performed herein shall be made upon completion of such work and receipt of our invoice. Unless a lump sum
price is to be paid for the foregoing work and is clearly so stated, it is understood and agreed that the quantities referred to above are
estimates only and that payment shall be made at the stated unit prices on the actual quantities of work performed by the Company
as determined upon completion of the work.
If the foregoing meets with your acceptance, kindly sign and return the attached copy of our proposal. Upon its acceptance, it is
understood that the foregoing, including the terms and conditions set forth and attached hereto and incorporated herein for all
purposes, will constitute the full and complete agreement between us.

TERMS AND CONDITIONS
1 Any deviation from the specifications or modifications of the terms of this contract and any extra or incidental work shall be set
forth in writing and signed by both parties thereto.
2. Company will carry Workmen's Compensation Insurance covering its employees and shall provide Public Liability and Property
Damage Insurance.
3 If, in the opinion of Company, your credit becomes unsatisfactory before commencement or at any time during the course of the
work adequate security shall be furnished by you to Company upon its request, or Company shall have the right to discontinue work,
treat the contract as having been breached by you and bring suit for the completed work and for its damages by reason of your
having breached this contract.
4 This proposal expires fifteen (15) days from the date hereof but may be accepted at any later date at the sole option of the
Company
5 Company shall not be responsible for, and shall be held harmless from any liability resulting from damages to utilities or any
other property buried or located within 16" of the prescribed working depth of this contract.
6. Company shall not be responsible for any damage to or deterioration of any of our work, whether completed or in process,
resulting from any cause or causes beyond our control, but not limited to failure of sub grade or failure of inadequacy of any labor or
materials not furnished and installed by us, whether or not such failure or inadequacy was or could have been known at the time our
work was undertaken.
7 In the event all work under this contract is not completed in one operation, Company shall be paid in full for all items of work
completed upon the completion thereof. Any work under this contract for which Company has not received a "work order" calling
for completion within one year from the date of this agreement will be subject to renegotiation of prices, or cancellation at
Company's option.
8. Company is not responsible for removing vehicles from repair areas. Company will notify you in advance and you must
make arrangements to have vehicles removed at your expense.
9 Terms of Payment - Final and complete payment for all work performed herein shall be made upon completion of such work and
receipt of our invoice. If the work continues more that one (1) month then payment in full for all work performed hereunder during
any month shall be made no later than the tenth day of the month next following. Interest at the rate of (18) percent per annum
shall be charged you and paid by you on all unpaid balances from the due date to the date of receipt of payment by the Company
Reasonable attorneys fees and cost of collection shall be charged you and paid by you, if incurred by us.
10 Payment for the asphalt/concrete paving improvements is due upon completion of that type work. Payment for the
sealcoating/strnpmg if any will be invoiced separately and will be due upon completion of that type work.
