V) I monitored the aspects of the Coppell Rd. project as it related to our Association.
Now that the roadway itself is complete we have two outstand~g issues that have et ty_~.Jg,~ '
be addressed by Ed Bell Construction. Approximately ~ ofthe-~- ' ~hrubs at our entrance at
Minyard Dr. and Coppell Rd. (the south side only) died dhring the project and have yet to
be replaced. During the course of the construction I had several conversations with Gary
Pryor, the project coordinator for Ed Bell Construction, about how the existing
landscaping not displaced by the construction would be maintained. Gary informed me
that they (Ed Bell Construction) would water any landscaping that was in areas where the
construction had displaced the existing irrigation system. Regarding the entrance at
Minyard Dr. Gary informed me that the irrigation was still intact. He even told me where
the meter was located on Minyard for that portion of the landscaping that I was
concerned about. I surveyed the location of this meter and determined that this most
likely did not service our irrigation system. I pointed this out at the time to Gary that the
meter he was referring to was on the north side of Minyard and that our association's area
of responsibility started on the south side of Minyard and proceeded south from there and
that I did not think that meter was for our irrigation system. He still maintained that the
irrigation for the entrance in question was intact and told me where he thought the
location of the controller was within our subdivision. There was no controller in the
location where Gary thought there was one.
In reality, the irrigation was not intact. I verified this with Tim Greer, the irrigation
coordinator for Carruthers Landscaping, who was the subcontractor responsible for
replacing the irrigation on that portion of the project that affected our association. I had
told Tim at the outset of the irrigation replacement about my concerns about any portion
of the system being intact at the entrance in question and what Gary Pryor had informed
me pertaining to this and that I needed to find out for sure because the shrubbery was
dead. After Tim verified there was no functional irrigation at the entrance in question I
called Gary Pryor and informed him of this and asked him about the replacement of the
shrubbery that had died. He informed me that if it was their responsibility they would
take care of it. Subsequent to that I have had other conversations with Gary about this.
However, in the last 2 or 3 conversations I had with him he is now giving me different
information.
At the conclusion of the construction of the roadway and after it had been completely
opened for traffic I called Gary about when the shrubs would be replaced. He informed
me then that he was waiting to get some sort of approval from his superiors to replace the
shrubs and that he would get back in touch with me. After a few weeks passed I
contacted Gary again because I had not heard from him. At this point he told me that
they had watered the shrubs in question during the course of the project and that it would
most likely be our responsibility to replace them but that he was still waiting for the final
word from his superiors. I reminded him that we had had several conversations about the
shrubs at this entrance during the course of construction and that he had stated that the
irrigation was intact and that now he was telling me something different.
The bottom line is, we have shrubbery that has died as a result of the construction on
Coppell Rd that needs to be replaced. The contractor told us it was being maintained
when in reality it was not. Our HOA should not have to endure the expense for the
replacement of this landscaping and we are requesting that Ed Bell Construction be held
to their responsibility to replace what was lost and that it be done in a timely manner.
Furthermore we are requesting that the replacement shrubbery be the same size that the
existing shrubbery would have been at this point in time had it not died.
The other outstanding issue we have is that there is some steel perimeter edging that has
not been completely replaced around one of our shrubbery beds on the south side of
Easwick at Coppell Rd.
