The exception in TAg 4.33.3 states: Ar, cessible viewing positions may be clustered for
bleachers, balconies, and other areas having sight lines that require slopes greater than 5
percent. Equivalent accessible viewing positions may be located on levels having accessible

Based on a recent court case, TDLR will apply the following criteria for purposes of ensuring
complian~ with TP~ 4.33. The accessible seating must be located in a way that avoids
physical discomfort- Discomfort usually occurs when the vertical viewing angle to the top of
the element being viewed exceeds 30 to 35 degrees and the lateral-viewing angle to the
ccnterline of the clcrnent perpendiCUlar to the scat exceeds 15 degrees. Exceeding each of
these may result in uncomfortable head and/or body positioning. This determination is based
in part on the guidelines established by The Society of Motion Picture and Television
Engineers (SMPTE EO 18.1994 recommendations for optimal angles of line of sight in
movie theatcr~).
Accessible viewing positions cannot be placed at locations where the person's line of sight to'
the top or bottom of the element being viewed (movie screen, performanc= stage, etc.)
exceeds 30 to 35 degrees vertically. The locations also cannot be placed where the line of
sight to the centcrline of the element being dewed exceeds I5 degrees laterally. The criteria
contained in this memorandum is not intended to be applied to sporting event facilities or
~pecialty auditoriums yuch ~ those d~signed and constructed for the purposes of showfng an
O~lhrl or an IMAX-O4~e film.

'rDLR recognizes the: need to form a stable framework in concrete surfaces for proper
alignment and installation of paver inserts at curb ramps. For purposes of design, TDLR will
accept a border not exceeding four inches (4") at the sides, top and bottom of the curb ramp
surface in lieu of "extending the full length and width' of the curb ramp as mentioned in TAS
4.7.4.

Self. service cm' washes .ere subjec~ to the Texas Architectural Barriers Act as a Public
Accommodation. A minimum of 5% of the car wash bays (but never less than one) must be
accessible and must comply with TAS 4.6.:3 and 4.27. (Note: controls and operating
mechanisms may include such items as the bay control box, coin slot, .change machines,
spray wand, and floor mat clips)
At least one bay must be designed to allow for use by a van. This bay must include the
minimum width required for a "Van-Accessible" perking space (16' - 0"), plus an additional
36" of' width on the opposite side fi.om the access aisle for an accessible route, for a total
clear width of 19'-0". This allows the user adequate space to exit their vehicle Md get around
all sides of' the vehicle. The surface slope of the 8' wide access aisle and 3' wide accessible
route in the accessible bay may not exceed 2.0°/. in any direction.
An accessible route must be provided from the bay to the change machine(s) and other
product dispensers, which must comply with TAS 4.27. If. other amenities, such es
vacuuming stations and drying areas are provided, at least 5% of these must comply with'
TAS.

We are frequently asked whether hardware can protrude into tho required clear width.
Therefore, we have developed the following position, the wording of which is derived from

There shall be no projections into the required dear opening width lower than
34 inches above the floor or ground. Projections into the clear opening width
between 34 inches and 80 inches above the floor shall not exceed 4 inches.

4.1.$(S) Exception I
It is no longer necessary to submit an Application for Variance when the criteria of this
exception are satisfied.
Exception 1 may be applied to mezzanines, balconies, porches, galleries, verandas,
basements, penthouses, and other areas meeting a_L//the following criteria:
· the functions are insignificant to tho buildings purpose; and,
· the area contains less than 2000 gross square feet officer space; and,
- the area does not contain activities or functions involving the sale of goods or acquisition of'
services; and,
. the area does not contain educational or employment opportunities not available in
accessible locations within the same building or facility.
The most difficult of these criteria to evaluate is what functions are insignificant to the-'
buildings purpose. Generally, a small (less than 2000 gross $.F.) storage mezzanine or loft in
an office environment or retail store, is insignificant to the function and Exception I could
apply. However, the office of the manager in that same office or gore, or in a supermarket,
is not insignificant to the function. Therefore, it should not be located on an inaccessible
level. Any design proposal to do so will only be considered by the department through the
variance procedures contained in Pule 68.31.

The fourth sentence in TAS 9.2.2(7) reads: At least fifty percent of shelf space in cabinets or
refrigerators/freezers shall be within the reach ranges of 4.2.5 or 4.2.6 and space shall be
designed to allow for the operation of cabln~t and/or appliance doors so that all cabinets and
appliances are accessible and usable.
Our position will be to accept the following from the Proposed Title II ADA guidelines and -
will be considered acceptable in lieu of making 50% of the shelf space accessible.
· Maximum height shall be 48 inches above the finished floor for at least one shelf
of all cabinets and storage shelves mounted above work counters.
This clarification does not alter the other requirements of this paragraph regarding clear floor
space, height ofcountenops and sinks, or controls and operating mechanisms.

element added to the existing building or facility shall comply with the applicable provisions

considered an alteration to the site or overall building, each addition that affects or could
effect the usability of an area containing & primary function shall comply with 4.1.6(2) which

It is not correct to apply the requirements of TAS 4.1.6(1) or cross-reference any other

TDLR has temporarily suspended enforcement of TAS requirements applicable to fuel
dispensers installed at subject facilitien where construction began prior to October 1, 1998.
The particulars of thc temporary suspension arc as follows.
TDLR suspends enforcement of TAS 4.2.6 (Space Allowances and It, each Ranges) and
TAS 4.27 (Controls and Operating Mechanisms) as applied to payment options on fuel
dispensers, where construction begins prior to October 1, 1998. "
Facilities where construction begins at~er October 1, 1998, a minimum of 20% of the
fuel dispensers, but not less than one per grade of fuel, will be required to comply with
TAS 4.2.6 and TAS 4.27. The 20% requirement applies to all facilities and is to

modification while developmental of sn accessible fuel dispenser is pending,
regardless of the method of installation.
Until such time dispensers are manufactured which fully comply with TAS 4.2.6 and
TAS 4.27, at least 20% but not less than one fuel dispenser installed at newly
constructed or modified facilities on or alter October 1, 1998 will be required to
comply with TAS 4.2.6 and TAS 4.27.
Fuel dispensers, which are installed at facilities constructed alter J'anuary 1, 1992 and
prior to October I, 1998, shall include a sign at each dispenser suggesting alternative
methods for obtaining fuel and/or assistance. Signs directing persons to compliant
dispensers shall be prominently displayed.
While conducting plan reviews and/or inspections it will be expected that reference to the
suspension will be appropriately noted on the plan review/inspection r~ort. However, if
compliant designs/dispensers are proposed/provided, it should also be reflected on the plan
review/inspection report.
This position shall be applied to any situation where a plan review and/or inspection has been
ar~omplished based on ~he dates referenced in the pani~ulan not~ above.

The position of this department is taken further to include the intent of tho work area
beginning at the door to the workspace.
This would not apply to "other" work areas within a work area such as an office, conference
room or other common use spaces not specific to the task.

Since 4.7.5 of TAS states that, "Ifa curb ramp is located where a pede~rian must walk across
the ramp, or where it is not protected by handrails or 8uardrails, it shall have flared sides',
this department has not accepted parallel type mrb, ramps (as shown in proposed 'Section 14,
Figure 59(b) of ADAAG) except through nn approved variance. However, our position is to
allow the use of these types of ramps without a variance.
This issue was discussed with various disability advocacy groups, and none felt that this
design posed any signifi~nt hazard to any persons with disabilities. The matter was then
submitted to the Architectural Barriers Advisory Committe~ for consideration. The
committee recommended accepting these types of ramps without a variance, as they, too, did
not consider them a hazard. Further, they felt that since this design appeared in proposed . ..
ADA Aecmssibility Guidelines (although limited to public rights-of-way, where fight-of-way
width will not accommodate a perpendicular curb ramp and landing), that accepting this
design would not pose a problem. However, we strongly recommend maintaining slopes of
5.0% or less for this design so that these will not be considered 'curb ramps". Otherwise, the
curb ramp must comply with all of TAS 4.7.
This position applies to new construction as well as alterations.

Schedule 40 standard sumctural pipe carrying an industry designation of 1 and 1/4" nominal,
and listed as having outside dimensions of 1.660" nominal, 1.629" minimum, and 1.675"
maximum, is acceptable for compliance to TAS 4.26.2.
The word nominal was inserted into TAS 4.26.2 to allow, without a variance application,
slight deviations from the specification that requires 1 and I/4" - 1 and 1/2" actual outside .,
diameter, which may result using various readily available building matcrials. We selected
the word nominal because of it's definition as "...size that may vary fi.om actual..." It was
never intended to bc so broad as to permit the use of any and all products which may be
designated as "nominal" by a multitude of manufacturers for industries.
For example, standard structural pipe carrying a designation of 1 and 1/2' nominal ANSI
Schedule 40 pipe is listed as having a nominal outside diameter of 1.900"; a minimum
outside diameter of 1.869" and a maximum diameter of 1.915". This would be unacceptable.

During the development of TAS, there appeared to be a reason to revise the ADA.A.G text in
such a way that there now appears to be a conflict between TAS 4.3.I1,2 and TAS
4.3.11.2(1) regarding the number of 30" x 48" areas required at an area of rescue assistance.
For purposes ofTAS only, TAS 4.3.11.2(1) is correct. The total number of 30" x 48" areas
per story shall be not less than one for every 200 persons of calculated occupant load served
by the areas of rescue assistance (ARA). All other instances where the occapant load is 201 .
persons or more, TAS 4.3.11.2 applies.
Therefore, ifthe calculated occupant load served by an AKA is 200 or fewer, only one 30" x
48" accessible area is required and if'the occupant load served by an AKA is 201 or more, at
least two act, essible areas that are at leas~ 30" x 48" are required.

common area of tho toilet room, bathroom, bathing facility or shower room.
TDLR is applying this same position to other types of fixtures and dispensers such as (but not
limited to) urinals, diaper changin$ tables, dispensers, bathtubs and showers.
If other types of fixtures or dispensers as described above are provided in the accessible stall
in addition to those in the common space, they shall be ac.~essible and not interfere with the
clear space required for any one fixture in the accessible stall.
