Representatives of the City of Coppell have confirmed a final inspection of paving and utilities for
the referenced project The two -year maintenance bonds and as -built drawings have been received
from the contractor Maturity on the bonds will be two years from the date of this letter Please
find your letter of September 29, 2005 attached to this letter as a reminder of your commitment
to escrow funds for Bethel Road improvements adjacent to the referenced development
You may notify the MS4 (City of Coppell) at any time during the two -year maintenance period if
stabilization of the site per the SWPPP permit can be demonstrated If so, complete and submit a
Notice of Termination (NOT) to discontinue coverage under the SWPPP permit.
follow -up inspection of the facilities will be conducted prior to the lapse of the two -year bond
period If any punchlist items are noted at that time, you will he contacted to make repairs

In response to your letter dated September 21,2005 from Kenneth M. Griffin to Craig Bond of
TranSystems (letter attached) Duke Construction, L.P agrees to pay for engineering and construction
costs required for the tie -in of storm sewer from the Freeport XIV XV site to the future Bethel Road
storm drainage system. In addition, Duke agrees to pay for approximately 1,200 linear feet of 5'
sidewalk to be constructed by The City of Coppell with the Bethel Road I project.
To ensure funding for the above, Duke Construction will place in escrow a dollar amount based upon a
scope of work and estimate prepared by Pacheco Koch Consulting Engineers and agreed upon by both
parties. This estimate will be prepared upon TranSystems' completion of the Bethel Road I plan
revisions required for the tie -in If in the event actual construction costs vary from the escrow amount
either Duke Construction shall pay the overage amount or be issued a refund check by The City of
Coppell for the remaining escrow balance.
