October 24, 1988 Dear Peter, This is to acknowledge receipt of your letter referenced above. Please note that the design as modified by this letter is totally unacceptable and I hereby disavow any/all association and/or approval thereof. As a registered professional engineer, I would never approve a design knowing that it was doomed to fail. I am surprised and disappointed that you and Nathan would offer such a pro- posal, knowing that the site configuration (90% bend in the creek channel at the sewer line/easement) is totally incompat- ible with this proposed 30 ft. long retaining wall. We all know that the only way this proposed retaining wall will sur- vive a maximum flow situation (creek water bank full), is to extend the upstream section of the wall above the major impact point of the current flow. Your proposal stops the retaining wall at the center of the impact area of the current flowing from upstream into the bend of the creek. Therefore, it is only a matter of time until the accelerated erosion at each end of the proposed 30 ft retaining wall, cuts behind the wall and eventually "washes it out". The city council, mayor and city manager do not want a tempor- ary solution. They most emphatically do not want the future liability of repairing, replacing or extending this retaining wall; which your proposal represents. Unfortunately the sewer crossing was placed in the bend of the creek. This location presents numerous problems that otherwise would never have occurred. As the respon~1ble party, "Nathan Maier Professional Engineerings! are obligated to correct the situation pursuant to the TSPE code of ethics. I would rec- ommend that whatever fix you finally decide upon, you affix your professional seal and guarantee the design for a period ""..... No one doubts your ability to design and implement a proper permanent solution. You may want to consider a 100 ft. long Gabion such as has been in place, in the bend of the creek behind the home at 217 Meadowcreek, for the past five years. Tliis Gabion preserves the natural asthetics of the area which you refer to in your letter and has provided the ultimate protection for the creek bank.
