In reviewing your letter, the description of activities of August 25 is accurate Our inspector pulled up to the fob to see regular gray concrete poured in the median and requested that the top 6" of the pavement be removed so that integral colored, stamped concrete could be poured per the construction plans The shake-on method was never discussed prior to this time The shake-on color does not meet the color specified by the city Our standard color is integral Red Clay from Bomanrte as spelled out m our ordinance We regret any m~sunderstandmg or additional costs incurred by the contractor for this mistake We feel that ~f a submittal had come to the City prior to attempting to pour this concrete, we would have been able to avoid this issue Due to the fact that our specification calls for integral color and no submittal was turned m prior to pouring the concrete, we do not feel that this error was m any part due to the City's negligence or ~nachon on this item. Therefore we cannot in good conscience agree to additional payment If you wish to discuss this further, we would be happy to sit down wrth all parties involved including the field supervisor of the concrete pour to discuss what was and wasn't said prior to the pour It ~s my strong belief that our inspector told them exactly what was expected and that a discussion about alternate methods could have easily taken place prior to pouring the concrete If you wish to discuss this further, please feel free to call, otherwise we consider the matter closed You will be paid the full agreed-to price for the work completed to date, but we do not intend to pay any additional claim for extra mone} for this issue Sincerely, Keith R.
