City Engineer City of Coppell Post Office Box 478 Coppell, Texas 75019 Re: Drainage Study Report for Shadow Ridge Estates and the Existing Kaye Street Lots in Coppell, Texas Dear Mr. Doyle: The following report is the result of our investigation into the drainage conditions in the subject area. This report is presented in four sections as follows: (I) Research and data collection, (2) Drainage conditions before Shadow Ridge Estates construction, (3) Drainage conditions after Shadow Ridge Estates construction, and (4) Summary. It is important to note that this report is based on available information. Due to cost limitations defined by the City, no field surveys were performed to verify elevations. The purpose of the report is to determine drainage conditions before and after construction of Shadow Ridge Estates. In summary, we have suggested possible solutions to the drainage problem. The details of these solutions are not included in the scope of this report. (1) Research and Data Collection A site visit was made to the area, and the drainage conditions were discussed with several of the residents. None of these residents were satisfied with drainage conditions. A search of files available at the City revealed the information contained in Appendix 1. This information was obtained from the Engineering Department, the Inspection Department, and by Mr. Gilbert Welsh at the Coppell City Council meeting of December 12, 1989. (2) DrainaRe Analvsis of Conditions before Develooment Appendix 2 contains a 2-foot interval 1985 City of Coppell topographic map which describes conditions that existed before construction of the recent Shadow Ridge Estates. We have drawn flow arrows to show the general flog' pattern that existed as a result of this pre-development topography. It is clear that the flog' drained to the north from the Kaye Street lots and then to the east, eventually paralleling Kaye Street. An important consideration of this flow is the flat slope along this drainage path (in some areas less than 0.2 percent). A slope of I percent is generally considered a minimum slope for proper drainage. Such a flat slope would result in a very slog' drainage of the area. Care should always be exercised when dealing with flat slopes since a slight change in topography could have a significant effect on drainage patterns. Mr. Russell Doyle, P.E. - 2 - January 8, 1990 Without more detailed topography (one foot interval or less) of the area prior to construction of Shadow Ridge Estates, it is not possible to more accurately determine the extent of standing water after a major rain. According to the United States Department of Agriculture Soil Conservation Service Soil Survey of Dallas County, the type of soil in the area of Kaye Street is a Crockett or Mabank fine sandy loam with 0 to I percent slopes. This type of soil can have a depth to the water table depth of less than I foot during the months of December to March. Also, it has a permeability rate of 0.6 to 2 inches per hour. This combination of high water table, slow' permeability, and flat slopes would produce conditions ideal for maintaining standing water for long periods. (3) Drainage Analysis of Present Conditions: Appendix 3 shows the Shadow Ridge Estates Subdivision superimposed on the topographic map of the area. A comparison of this with the conditions shown in Appendix 2 clearly demonstrate that the drainage patterns of the Kaye Street lots have been altered. The flat topography and lack of verified field survey data make it difficult to determine the exact extent of the change. However, some generalizations can be made. I. The flow path for drainage water leaving the Kaye Street lots has been restricted. Some of the drainage water now flows along the fence line, and some makes its way to the drainage swales between the Shadow- Ridge residences. In either case the flow area has been reduced. With shallow' slow moving water this could result in a higher water level. 2. The flat topography does not leave room for latitude in grading. A few inches' variation in grading can cause standing water over a wide area. 3. The direction of flow leaving the Kaye Street lots has been changed. The pre-development flow would drain north past the Kaye Street lots north property boundary. At this point, the flow, would continue north for as much as another couple of hundred feet and then gradually turn east. (4) Summary There is no question that the Kaye Street lots are experiencing a drainage problem, and it is apparent from information available that the Shadow' Ridge Estates Subdivision has altered the drainage compared to pre-development conditions. However, it is not possible to quantify the resulting drainage change without detailed field surveys and a more extensive study. - There are a number of potential solutions to this type of drainage problem at the Kaye Street lots. It is not within the scope of this report to investigate these in detail. However, we present several options below for general consideration: 1. Grass-lined swale: A grass-lined swale could be constructed along the north Kaye Street lots and south Shadow Ridge Estates Subdivision property line. This would probably be the least expensive option from a construction _ standpoint. However, this method is not recommended since it would require such a large area, and there is not enough available slope to properly drain the swale. Finally there is the problem of where to drain the storm water. Mr. Russell Doyle, P.E. - 3 - January 8, 1990 2. Concrete-lined swale or alley: This would be a more costly approach, and would have the same problems as the grass-lined swale, except that it would not require as much width. 3. Storm drain: This seems to be the most feasible option. A storm drain could be constructed between the Kaye Street lots - Shadow Ridge Estates Subdivisions. This storm drain would drain each of the Kaye Street lots by use of an "at grade" inlet pipe and grate. This system is often used in parks and other grassed locations. The lots draining to each inlet must be properly graded, and the inlets must be kept free of debris. The system requires frequent maintenance. The drain could be connected to another downstream system or discharged to a downstream tributary. The key consideration in this system is that it must have sufficient slope. This may require carrying the storm drain for a long distance to achieve sufficient slope. In conclusion, we have determined that the area along the Kaye Street lots probably drained poorly prior to construction of the Shadow Ridge subdivision, and that this may have aggravated the _ drainage problem. The solution to the drainage problem would require a detailed study. However, with the limited information available to us at present, it appears that a pipe storm drain system could be constructed between the Kaye Street lots and the Shadow Ridge subdivision to alleviate this drainage problem. The cost of this pipe drainage system would be in the range of $112,000, -- depending on the length and size of the line required to carry the storm water and the size. The other two methods mentioned as potential solutions are much less likely able to solve the problem, although we cannot be sure without survey' data and more study. The grass lined swale would be the least expensive option, probably costing approximately half of the other system. The concrete - swale would probably cost about the same as the pipe drainage system. These costs are based on very preliminary information and could vary considerably. None of the costs consider acquisition of a drainage easement. Each of the systems would require precise design and detailed land _ surveying. We would like to point out that these improvements address drainage at the adjacent property line. Off-site problems such as low spots on a Kaye Street resident's property would be their responsibility. In that meet~g I informed the people attending that the city bad been investigating the drainage complaints of residetus along the north side of Kaye Street. Investigation of file drainage problero_s included ~speetion of the property, a~ud review of all drainage plans ,and topography maps by Ginn Engineering. Review of those plans by Ginn indlea:ed tlmt much of the water was intended to be drained in an East to West and West to East manner rather than a South to North manner. Investigation of the site rev:'~ed that some of the lots on Kaye Street were not maintained in a manm'r that would allow the quick run-off of water. Items that slowed the flow of water included brush or high grass and the storage of construction materials along the rear property, t~notber item that was cited by Ginn Engineering was the lack of adequate clearance between the fences a'.ong Spanish Moss and the ground. [ informed those at the meeting that Fox and J'aeobs had already agreed to cut off wha: ever was needed of the fences on Spanish Mass to allow adequate flow of water underneath those fences within the swale area only. I also asked that the citizens ,-dong Kaye Street remove all brush and high grass at the rear properties along with any stored construction material. According to Ginn Engineering if these steps were taken the drainage problems would be lessened and possibly be resolved all together. I also informed the residents that the City :,,'as also pursuing' other matters to resolve the drainage situatien as well. If it was deterwdned that the maintenance approach did not properly take c~e of ail of the drainage problem_~. the City would take steps to propose a bond issue to install a concrete flume along the rear property llne. The concrete flume would be installed ,and graded in such a way to a|low the run-off of all water from the rear properties of Kaye Street and Spanish Muss. Ctu-rently the City of Coppell has received approv,'O, from Texas Waste Management to have citizens take items to the landf'dl the secoml Saturday of each month. The second Saturday in December will fall on December 9. Texas Waste Management has also agreed to allow citizens along Kayo Slxeet to take items to the landfill the .~ollov~:ng Saturday wlfic~ would be December 16. This letter will allow you to enter the landfill without the usual cost involved. The letter must be presented to the guard at tbe gate when entering the landfill in order to receive free admittance. Landfill hours are from 6:00 a.m. to 1:00 p.m. Once residents have removed all brush and materials, they are to contact me at 462-9010 and recluest an inspection of their property, so that I may determine whether or not it has been cleared out in a sufficient manner. According to the survey shots furnished, it appears all these lots will drain adequately, provided something is done to enhance the flow from back to front as intended. We would like to point out that there appears to be a slight windrow of soil along the adjoining property lines of Kaye Street and Spanisl~ Moss. Although we did not discuss this previously, it warrants looking into because it further impedes the drainage off those lots on Kaye Street. Also on lot 52 or 53 there is a transformer pad. At this location, drainage off the acreage Just South-West is also affected by a slight berm of soil in this area. I am here tonight representing my mother who lives at 412 Kaye Street, here in Coppell. I would like to start first of all Mr. Mayor and Councilmen by thanking you for your time and allowing me to speak to you in regard to the problem that my mother has. I do in regard to the lady that spoke earlier, the Christmas Spirit Award, enjoy seeing the lights in Coppell. E1 Dorado and McKinsey in Coppell I think are the two (2) premier plaeas to view Christmas Lights at Christmas season, and it makes the trips to Coppell en]oyable at Christmas time. It would have been nice, too, if you had furnished us with a chauffeured limousine in which to attend tonight. But I would to briefly make each of you award of the fact of who my mother ia. My mother and father have lived in Coppe11 for ~7 years. They have lived in the house at 612 Kaye Street for 30 years. ! grew up in that house. The area that I am going to point out as a cause for the drainage problem is an a~ea that I played in as a kid. It was the woods that Y played in. The point being I am familiar with the area as well, myself, and how it drained. I was in the first high school graduating class that Coppell had, eo I go back a lon~ ways with Coppell ss vel1. And l know that in sending the information to you folks I sent one of these (a set of these notes that I had taken). Well I'm sorry, I see a head shaking "'no"', I am sorry if you didn"t receive them, but I did send s set of those. I am going to use those as a guideline to go through tonight. I'm not going to read from them totally, but I am going to use those as a chronological guideline if you care to follow along. I think that when you people took office you took an oath stating you're of sound mind and of good moral character. That being the case, I trust that you are solaE to agree with me when I finish tonight. (Ah, you're supposed to laugh, gentlemen) None the less I have soma displays I want to make. ~ere would be the appropriate place for me to place the easel? Mayor Wolfe: All I got was that letter from you. Councilman : You sent me a copy, Gilbert and I forwarded it on to Alan some time back. (unable to understand next comment) That's been awhile back. Mr. Welch: I sent you a copy some time back, and then about two weeks ago I sent a letter, I think addressed to you Mr. Wolfe, to the City of Coppell at this city address here. With that and a number of other documents attached. Mayor Wolfe: Okay, I did not receive it. I received that letter that you wrote after I talked to you (that I received about two or three days after I talked to you. Transcript of Item 13 Ninutes 12/12/89 Page 2. Hr. Gilbert: Right,well, I did send another package. Itm sorry you did not receive it. The meetfn~ ! had first of all to get tnvolved with the City vas on ~ecember the loth. This was after a long period of my father trying to resolve the problem over a year In ti~e, sn~ being very unsuccessful in doing so. Hy father, and I am not crying to bore you with details of my family history, but this is germane to my involvement. ~y father became very i11~ and he wes terminally i11. He passed away on February & of this year. It was important to my father that he resolve this problem for my mother before he died. He got to the point where his health would not allow him to 8et involved and do much about it. I promised him that I would zee this through. He became very frustrated. Ee was very upset. I told everyone when I met with them initially that that was one of my main purposes, at least to have some positive action so that I could put my father's mind at ease. It upsets me that Ky father went to hie grave with that really tormenting him. It truely did. I'm not Just creating s smoke screen. It was really tormenting him that he feared ~as leaving my mother with a problem she has. Hy first meeting was on December 19th with Hr. Alan Ratliff, and he suggested that I meet with Russell Doyle, and I did sO. I told Russell, again, that I wanted a quick resolution because of my father's situation. I'm not going to go through that each time, but I did tell each one I talked to that that was something very important to me. But I asked Russell to review the problem with ~e. ~e did so. He came out to ~y mother's house (my perenc's house). He concurred that there vas a problem. He concurred that the attempt to solve the problem, thac bad been done until that time~ vas inadequate at least for a long ter= solution. On December 27, Russell visited with folks fro~ Fox & Jacobs, who are developers of this property. A gentleman by the na~e of Hr. Steve gtolte, and they felt, according to Pussell, (they passed on to him that they felt) the solution existed. That the problem really no longer was there. Ah, and didn't feel they neede~ to do snythin~. ! asked him to get them to the house and look at the situation. He said he would do so, and they did not come. ? talked to Russell and asked why (that was on December 28), and he Just asked that I wait and have him get back in touch with me when he hsd a chance to make some progress. And so I did. He asked ~e to be patient, and ! was being patient. On January 3rd, I talked ~ith Russell, and he told ~e he was going to send out a letter because he had gone, he felt, as far aa he could with Fox & Jacobs. ~e couldn't get any results. Mr. ~elch: ! don't know, 8entlemen, I think its probably better for me to do it this way. This is the letter that Russell sent, and it says (the date of this letter is January 15, 1989, it's actually dated '88 ltts incorrect, it's the problem a lot of us have ~hen the year changes you forget to change it on your dates. But it ~as January of this year, and this was a part of what ! sent in that package to you, Hr. ~olfe. ~ayor ~olfe: .... we%e got that here, yeah, ~r. Gilbert: This is a letter to Tom Houser of Fox & Jacobs from Russell Doyle. He says, although you state that these lots would be graded when building takes place, I convey to you that this will not satisfy the im~ediate needs of the City of Coppe11. Hy point being, your City Engineer was telling Fox & Jacobs that what they were doing would not solve the problem. Ah, in this last paragraph on this page; I notified the City of Coppe11 via phone and by copy of this letter of your intentions to resolve this problem. So Fox & Jacobs at this point was passing on that they intended to resolve the problem. Second page of that letter, it says; "during the last rainfall water ponded, it was some depth in Hr. ~elch's back yard in and around the fence separating Transcript of Item 13 Hinutes 12/12/89 Page 3. the lots, and at some distance from the fence. ~ile as s professional employed by the City of Coppell I cannot totally confirm Hr. Welch's statements regarding the drainage prior to development, the information available to me, as enclosed, appears to provide some relatedness of your subdivision to the drainage problem to Hr. Welch's lot." ~hat Hr. 9oyle told me by phone, that he said he would not put in the letter, was that he agreed that what I told him was occurring in tec~s of drainage prior to the development was correct and that was supported by city records. Fox & Jacobs is saying that vas not the way the water drained. I report to you that it is, and I'll show you in a minute how that drainage was occurring. (that is the way the drainage occurred) at this same point in time, I was getting information floe the City in regard to as-built drawings. In terms of putting you in the proper perspective - this is Kaye Street and this is Spanish Hose, the cul-de-sac on Spanish Hose. These are the two (2) Fox & Jacobs lots that are behind my mother's property. This is the area right here where the drainage problem occurs. This land drained this way .... there was a pond right out here, when I was living at ho~e with my parents. (is showing drawings apparently to the Council) The natural flow of water was in this direction. These lots were built up two end three (2' & 3') feet, and that*s not an exaggeration, gentlemen. These lots hsd dirt hauled in end they were built up. It stopped the flow of water. The flows back to this point, and it can't go any further. Its stopped. There have been attempts to put swales here. There's a ditch that show you a picture of later that runs do~m beside this gentlemen's driveway. It's very unsightly, lc doesn't even allow for adequate slope to give proper drainage, and its certainly not a good long term solution. Its not even e short term solution, the water still ponds. This is the, for chose of you that may not know, this is the area involved in how the two properties relate to one another. This is also a copy of a portion of the as-built drawings. You may not be able to see it very well from that distance, but this shows the contour lines. The land is falling this way, back toward this pond. It shcr~s the mound here, s mound there and a mound here. Those all did exist, I used to sit on those mounds and shoot frogs with my pellet gun when I was a kid. I know they were there. Ah, and the water drained in this direction. Fox & Jacobs is saying it drained in an east/west direction. That is absolutely not true. That is a falsehood. 14hen they built these lots up right here, they restricted the flo~ of water. Also this being a part of the as-built drawings on the drainage plan, this is the break they're showing for the water to go to the south and to the north. It is out of proportion because the xerox copying, I think most of you are aware that that distorts the ratio, but its about 5* to 8' on the original drawings. ~lch indicates that the engineer knew that he was going to have to shed water onto Eaye Street in the opposite direction from what it was already running. He is showing this being the break point, which would indicate that he would have to come on my ~other'e property and fill in order to get it to drain this way and that way. They never asked to do that. They never did that. That wouldn't work necessarily anyway. It would cause other problems with drainage on these lots that are very flat, and drain very slightly to the north. On January 6th I came up here to City Hall and met with Dorothy Tiauaons to acquire a copy of the petition that was filed by my father sometime back in October of '87. I helped him prepare that petition. She could not find it in the City files, and I'ye checked since then with the City to get it. The City does not have that on file. Mr. Welch: Okay, here is s copy, and I'd like to read one paragraph from that. It says, "As a result of this altered drainage pattern, water now stands in our rear yards for long periods of time after rains. This prevents us from enjoying the highest and best use of our land as allowed by State law and the Comprehensive Plan by the City of Coppall. As was enjoyed for many years prior to the development that has been allowed to take place north of our properties." I think that comment speaks for itself, and my parents were deprived of that privilege of enjoying their property, I've met shortly with Hr. Rstliff and discussed the problem again with him. ~e're kind of to a point now where the City wasn't doing anything. I viii to point ouc too that the there are ten signatures by citizens on Kaye Street (citizens of the City of Coppel!) on that petition. But, I told Hr. Rstliff that I hsd kind of reached a point where I didn't know what to do sn}n~,ore. didn't feel like the City either wanted to or couldntt do anything for what ever reason nothing was happening~ and I feared chat I was back to the point where my father was encouraging me to ~o when I first got involved. That was to get involved in legal action, which gentlemen don't want to do. I don't think that's healthy for any of us, all it does is make la..ers money. Ne aren't trying to cause the City to do something or anyone else to do something that we don't feel that they're responsible for causing or played a part in; sad vs Just don't want to be wronged ourselves. That's truely our only intent. I told Er. Ratliff that it appeared that was about where we had reached. He suggested that maybe I try s little harder ~itb Fox & Jacobs personally. Ah, so I set out to do so, and I will Foint out that &27 Spanish goss and &31 Spanish Hoss are the two addresses on Spanish Hose that are directly behind my parent's property. Ye had plan approval on one of those on 6/09/88, the other one on 9/27/88. Building finals ~ere issued on 9/23/88 and 11/5/88. Fy point being, there continued to be a cooperation on the part of the City of Coppell with the developer to continue to accentuate the problem. It doesn't appear to ae et this point that there was really a sincere effort on the Cit?s part to help correct that problem thac had been caused by bringing pressure to hear on the people that were causing the problem. Ah, at this point, I would like to point out (I do this at this time because this is chronologically in tbs time frame where ! quit monitoring how much water, How much it was raining, when water wss standing, when it wes muddy. But from December 27 to October 22. That's December in '88 to February 22, '89, I did a virtual deyly check on the condition of that property in person or by phone. Did it rain? Is there water standing? Is it ~ddy? Is the pond in the back yard frozen? gtc, etc. And that's all documented in my notes here, if you care to follow throuRh with it. There are only four days that are in question. Put a question mark there. I did not specifically check on chose specific days. Every other one of chose days, water standing, water standing, water standing, water etsnding, muddy, muddy, muddy, water standing, etc. etc. I report to you that there are 54 of those 58 days that that land was unaccessible. It was either muddy or under water for at least 5& of those 58 days. In actuality it was either muddy of under water 58 of those 58 days. Rut can support with a physical check or a telephone check on a daily basis that that was the condition for 5t o! those 58 days. At this point, I got in touch with Bill Allen, and Hr. Allen is the area president of the Fox & Jacobs Company. ~e suggested that I take this up with Steve Stolte. But told his I would talk with Hr. Stolte and taks it up with him if hs'd hays Hr. Stolte call me. That was on February 20 - l~d like to back up Just a minute - on February 9 there is a letter to the City from Ginn Engineering, who is the Engineer that you hired to do the inspection on this property. In the third paragraph of that latter, it says; 'I would liks to point out that these improve=eats address drainage at the adJacsnt property line. All site problems such as iow spots on Esye Street resldant's property would be their responsibility. I suggest to you that that's a very irrsspousibls position for an engineer to take. And I suggest to you that the reason the engineer takes that position is because they approved the drainage plan that doesn't work. Its faulty and that's the reason they take the position that it is the Rays Street property o~nsrs problem. The problem was not crested by the Kaye Street property owners, nor should it be their financial rssponstbility to fix the problem. Back to my meeting with Steve itolts (or my convsrsation with Bill Allan in regsrd to Steve Stolts). That occurred on February 20, on February 22 I had not heard from Hr. Stoics. He had not called sa ~r. Allen said he would, and so I called Er. Allan again. ~r. Allen reported to ms (this is on page 16 of my noise that I sent you) that he had been there the day before and the water was not standing. (and this follows through on page ]5 if you care to follow along while I paraphrase what it says there. In that there wasn't a problem, he was there the day before and he didn*t think thsre vas a problem. I told Hr. Allen that I had a $100 ~ill in my pocket, I would meet him there, if he walked in the back yard and not get water, or did not get mud up one inch on his shoes that I would give him my $100 bill; but if he did he would give me his $100 bill. He refused to meet me on that basis sad I don't blame him because he finally concurred that yes it was extremely ~uddy. Hy point being that there's been an attempt all along to say there is not a problem and when the issue has been forced to prove that there is still they just don~t accept the responsibility for fixing the problem. Nov I get on the City Council Agenda and all of a sudden the City decides its important enough to call a meeting. It appears to me as though the City's merely or City Staff may be trying to make it appear aa though we're working on this problem, when they're actually not. So I had to wait another t~o weeks for them to do that. I was the reason, my request vas the reason he was shootiug the grades. Then after that it was, well we only ~ot the back five (5') feet ye need to get the rest of your lot. I Just think it vas a delay tactic on their part. But I do have the ~radee that they shot. This shews that the property drains from front to rear in this area. lc drains this way on this side of the house, But it clearly drains from front to rear. Yon ~e ever the fence and it goes up hill. It clearly shows that on this plan. With that ~r. Stolte sent me a note that you have in your package that closes by saying, "We will try to resolve your problem shortly. Please call." I called. Literally, it vas about six weeks or so before he ever returned my call, after me calling no less than eight or nine times to get hold of him. Then he told me that they had decided they weren't goinE to fix tbs problem. It was-they had talked to the City of Coppe!l and the City of Coppell had told them that they had done all that they had to do, and that they did not have to fix the problem. I ask who told them from the City of Coppell. Mr. $tolte told me that Tom Houser had talked to Hr. Dele Jackson and Mr. Dale Jackson hsd told him that he didn't have to do anything else on the grading. ] have approached Mr. Dale Jackson and Mr. Jackson denies that. I don't suggest to you which one is true or which one ia fa]se. I'm Just tellinK you that's what I am told. I asked Mr. Stolte to confir~ that in a letter, and I never received the letter, but Mr. Stolte never did a let of the things that he said he would do. In your block meeting, it was called for November 27 st 7:00. My mother did attend, my uncle did attend. My mother was represented by herself and my uncle. Basically the suRRestion to me was - everyone clean up their lot and get all toe trash out of your back yard, mo~ the sraes, clean it up; then lets let it rain to see if there is e problem. Well my mother's yard has been clean for a long time. There vas a little high grass and weeds that grow between the two fences (Fox & Jacobs put a fence a foot away from my parent's fence that's been there for years, and it creates a place that's hard to clean, to mow, etc. But my uncle promptly cleaned that out. Be cleaned that out on the 29th I believe of November. He called on the 5th for an inspection as was agreed in the meeting that the citizens would do. On the 6th, Mr. Dale Jackson returne~ the call, said he would come the next day, he would call first. My mother stayed home all day. There's not been an inspection on that property. My problem with that suggested approach is that that does not solve the problem. The water does not Bo east & west, it goes from south to north. Water that's on my mother's land does not come from my neighbor's land, nor does the water on their land come from my mother's land. The letter that Dale Jackson wrote, es a result of that meeting says, "review of these plans by Ginn indicate that much of the water vas intended to be drained in an east/vest and west to east manner rather than a south to north manner." They went back out last May end did another survey or sll of the lots on the south side of ~panish Moss, which indicated that the lots were in compliance with those plans that ~ere originally approved by Glnn in February cf 1988. So aC that point, we mac with Ginn on the s/Ce, walked several of the lots and what was stated et that point, (that meeting I held with Mr. Gtnn and Mr. Fart - what they stated was that they had reviewed the topos and originally those lots were to drain in an east/west and west to east manner. Yet there was some flow to the north, but it was not very much at all and most of it was west to east and east to west. k~at they suggested at that point, was that there were some lots on that block that were obstructing the flow of water in the west to east and east to west manner and that we talk ~ith those homeo~mera aud try to get them Co through maintenance keep that area clean of the brush and weeds and the construction materials that were stored in the rear properties. So we started working on that and ended up sending out the letter subsequent to that suggestion by Gtnn, and that's when we did have the block meeting with them in February. I did get a call from Mrs. Welch lest week~ and what I was waiting to do wad to try to handle several o£ the calla st ova time, rather than 8o out for each individual house. We have gotten a couple of other calls today, and I do intend to go out and take care of that (to see exactly what was done). Mayor Wolfe: Dale, let me ask you a question here. You make the comment here (in the letter fro= you) and there's been letters from Cinn that basically states (there are some statements here that this may not work) and then there is a statement here, "If this does not work and rains come, we'll have to look at the concrete flume." One dated November lO, 1987 says, "Since these lots have always drained northward, we must request at this time that drainage be provided immediately across lots 6& through 51 to accommodate drainage." And then in January of 1988 there is another letter that indicated that these lots will drain adequately provided something is done to enhance the flow frcm back to front as intended. I interpret back to front to mean north to south not east to west. So Vayneta firm was very clearly operating under a different assumpttcn in late '87, early '88 in their letters to Fox & Jacobs, so you know, really question the veracity of the stuff we're getting in 't9 saying its supposed to be east/west all tbs time smd that the problem ia that homeowners aren't keeping their yards up. I think there is a problem ia the way the subdivision was constructed, end I think we need to do something to address the homuo~mer'a problem either by asking the developer to correct it or have the City get involved in some Heyor L'olfe: Okay, Hr. Could you tell ~s ~hat your recollection of that, ho~ your firm van intending to solve that or what the resolution of that was. I'm sorry to catch you flat footed; appreciate you being here to talk about this. Steve 8tolte: Steve Stolte~ Fox & Jacobs~ 9807 West Valley Ranch Parkway. irving, Texas. We've talked about this and met with Hr. on it several times. ~e bought these Iota and they wars developed and the earth work was done by another developer, and we bought those lots. We didn't build on them after a substantial amount of tiaa, and in that period, you know, there was no problems until we started building houses out there. We tried to address the problems when we were building the houses. We cut some swales up in the driveways on the houses to the east of Hr. Welch's that ye could get ~em and drain to the north in between the houses. ~e cut chose swales so ~e can get 'em aa best we can. ~ia property, that property up there vas basically fl~t. Ye had the grading plans and looked at it. We could get it where it was less than what we consider an ideal minimum grade to drain that property up there. Ye tried dressing to lot (?) on the side that we built. ~e sold a lot up there that Horton had, and wa wanted to put a flume in there right at the property line, there's a driveway that goes through there. That homeowner didn't want to put a flu~e even though it helped their driveway, and later on we put a ditch there. They ended up later on filling the ditch. I don't kno~ if they filled it, but they put an Transcript of Item 13 Minutes of 12/12/89 Page I0. Irrigation system in there and said they won't allow us to do a ditch. So pretty ~uch what it is is there is almost, its very hard to drain Mr. Welch's property to the north. ~ow there was sometime way back wben...and this has been going on for about a year I think now. There was a lot of debris in back of his property that's got cleared up that I don't know if the water was there beforehand or whatever. But his almost is flat itself. We've surveyed it and there are some shots that his property was basically flat. We tried to drain from the back of his lots all the way around the house. Our grading plan does at the house to the north does drain from the rear of their property line all the way around their house. That does drain. His, in Mr. Welch's tract is so flat that it doesn't hardly get to our tract, and then that tract that we had that we bought the lot from is almost a little bit higher. the recommendation that we have to get, you know, for Mr. Welch. He needs to fill up a little bit ou his property, I think, and try Co get the water away from his house and his garage. I think he's got tbs garage in the back. And try to get it out and get it to his northeast corner, 'cause if it gets to that fence at the northeast corner then it should drain to }lazy Moss (or something like that). But that's where it was and Mr. Welch at thaC time had put some dirt in there, and I think it had rained, it had done a lot better Job in subsequent rains and then that's where - ! don'~ know what has happened to it since, but I know he had put some dirt in there and it hsd rained. Its all, a lot of it is from the massive rains we hsd in ~arch and ~hat, but I know those lots, we never did anything to those lots after we bought them. We bought them like three years ago, and now it lust only came up a problem say within the last year. We are not the developers on that Tract. He got with the Fox & Jacobs engineers end began working (with it (?)) through that. In February he had a set of as-built plans that he reviewed and stamped and said that this will work. He had worked it out with their engineers, and that, I believe, that there were cwo separate letters. One yea to me from Hr. Cinn, and the other was written by ~alter £11iaon. I believe the one from ~r. fllison stated that uhat they were concerned about in that situation was that fences or other items could block the flow of the water, and tha~ should be taken into consideration as well. L~at the intent in that situation was to provide a separation between the bottom of the fence and the ground. That's what we had attempted to do in that situation. Hayor ~olfa: Council, I don't believe that there ia any way that decision can be made tonight, because it has to be a monetary decision. gould you consider the fact of staff to come forward next Council Nesting; what it would cost to remedy the situation in total. There is e statement here to clean out the shrubs and the bush and the what have you and do ao~e work with the fences - and see if that works until the rain season again. Per the City's request, the owners have re-graded lots 44 through 5! to accommodate the Kaye Street residences. These lots were graded to drain from back to front (ie., South to North) beginning from the lowest point of adjoining property lines with Kaye Street. We would like to point out that these improvements address drainage at the adjacent prope~'-ty line. In our opinion, the work required by our firm, has been discharged fully and completely. We would like to poinn out, again, that we had no jurisdiction on some items such as: off- site drainage improvements (or lack thereof) of Kaye Street residents, monitoring home construction activity on Spanish Moss lots, review of individual lot grading plans, and review/approval of individual homeowner fence locations, all of which still appear to be contributory to the problem. Since there was no "previous contract or Consultant Work Order Authorization", we feel that should the City request us to review the civil plans of the subdivision in question, and provide corrections to the problems, we will require a current Consultant Work Order Authorization. Additionally, we feel that the time recently spent on research, reviewing the files to determine our responsibility, a field investigation and correspondence is not a par~ of the work completed last year and will be billed at our current hourly rate. CONSULTING ENGINEERS MEMORANDUM To File: Date: September 18, 1989 Subject: Kaye Street Dra'inage A meeting was held regarding Dale Jackson's letter to Ginn, Inc. dated September 6, 1989 concerning the resolution of drainage problems along common property line of Kaye Street and Spanish Moss Court to the north. Those present were Dale Jackson, Wayne Ginn and Gabe Favre. Dale Jackson explained his position regarding pressure from citizens along Kaye Street, through the City Manager. Citizens are still complaining that the new construction to the north is cause of water standing in their yards. They have threatened City with lawsuits if something is not done. They say that until subdivision was constructed, their land always drained properly. A cursory site investigation was made and we found, along some of the Kaye Street residents' rear (north) property line, debris, trash, grass clippings, structures, etc. that are impeding natural flow of run-off. We investigated a lot or two on the north. The fences that have been constructed may be contributing to the problem also. It appeared that a lot of the swales, between the homes, were in place and looked to be properly graded to drain to the north. We did not investigate all homes. After Ginn pointed out potential deficiencies in positive drainage situations, Dale Jackson indicated he would contact Fox and Jacobs again and have them come out to help remedy the problem. He would suggest that 2-3 inches of the bottom of the newly constructed fences be removed and that a re-check of the swales be performed to verify positive drainage to the north. Additionally, Jackson would prepare a letter to Kaye Street residents requesting that they clear up their own backyards in an effort to help the drainage situation. Ginn told Jackson that Ginn, Inc. has done everything it could from an engineering review standpoint and that the City should seek cooperative effort between the affected homeowners. Ginn also mentioned that we could design a stormwater system to remove the surface runoff; but, it would involve getting easements from property owners either side of the boundary line, removing all fences, and other obstructions, designing a swale and/or underground storat drainage system to remove the runoff. The cost to do this work would not be cost effective in our opinion. Suggesuions were made by Ginn Engineering that much of the drainage problem was caused by poor maintenance of the rear yards by the Kaye Street residents. Items cited involving poor maintenance included high grass and weeds, storage of materials and accessory buildings located within an area where water would normally drain. Residents: Due to recent concerns from residents along your street, we inspected the property in your area to detez,~ine what could be done to resolve the H~ainage problems. Grading plans for your street indicate that water normally flows from West to East for the area that is {mmediately South of Spanish Moss. The inspection revealed that the rear property area of several of the lots on the North side of Kaye Street were maintained in such away that drainage from West to East tended to be blocked. Items that contributed to the blockage included high grass and weeds that had not been mowed, storage of materials along the rear property line and the construction of buildings adjacent or close to the rear property line.
