SMITH, PE ALAN RSUCKER, PE Mr Steve Swihart U S Army Corps of Engineers Environmental Division, Regulatory Branch CESWF-PER-R P O Box 17300 Fort Worth, Texas 76102-0300 Re Modification of Tributary G-1 Downstream of Bethel Road West USACE Project No 2004001 S 1 Dear Mr Swihart, As required in the approved mitigation plan cued ~n special conditian 1 of the U.S. Army Corps of Engineers (USACE) permit letter dated May 4, 2005, the following information is submitted for your records This letter constitutes the second annual written compliance report, due October 1, 2006 as stated m the mitigation plan cited ~n special condition 1 of the above mentioned permit letter The deed restriction for the stream mitigation area required under condition 2 of the permit letter is still being developed. The City of Coppell has met with the current property owners to negotiate for attainment of easement ar right-of way to facilitate modification to the stream channel and approved mitigation. Possible land swap as compensation for the right-of way is being presented. One land owner has agreed to the City's offer and negotiations are continuing with a second land owner. After agreement is reached with the second land owner, a draft deed restnctton will be submitted to the USACE far review and approval prior to being filed with the County Clerk.
