THAT THE TERM GRANTOR used herein shall be construed in the singular or plural number as
such term respectively represents one or more than one person.
THAT, ARC SPEI I, L.L.C., known herein as GRANTOR, in consideration of the sum of Ten and
no /100 Dollars ($10.00) and other good and valuable consideration in hand paid by the City of
Coppell, Texas, receipt of which is hereby acknowledged, as well as the commitment made herein
does by these presents grant, bargain, sell and convey unto the City of Coppell, Texas,
"GRANTEE on the terms and conditions set forth herein, the free and uninterrupted use, liberty
and privilege of passage in, along, upon and across the following described property owned by the
GRANTOR (the "Easement Strip for the purpose of constructing and maintaining an underground
sanitary sewer and drainage system across GRANTOR's main tract with the right and privilege at all
times, of the GRANTEE herein, its agents, employees, workmen and representatives having ingress,
egress, and regress in, along, upon and across said Easement Strip for the purpose of making
additions to, improvements on and repairs to said sanitary sewer and drainage system or any part
thereof.
Said Easement Strip being described in Exhibits "A" and "B" attached hereto and made a part hereof
for all purposes.
That in consideration of the benefits above set out, GRANTEE will remove from the Easement Strip,
such fences, buildings and other obstructions as may be found upon said property. After construction
of the underground sanitary sewer and drainage system has been completed or after any entry for
repairs or maintenance, GRANTEE shall, except for removed obstructions, return the surface area of
the easement strip to its original condition as nearly as practical taking into consideration the nature
of the work being performed, including the repair or replacement of any existing buried utilities or
streets and the replacement of any mobile home site improvement damaged or destroyed.
GRANTEE shall provide CRANTOR with as much notice as may be reasonable under the
circumstances whenever work is to be performed and will use reasonable efforts to complete the
work in a timely fashion and with as minimal disruption as reasonably possible to GRANTOR and
GRANTOR' s tenants. GRANTOR reserves the right to use and maintain the surface of the easement
strip for purposes which will not interfere with GRANTEE's rights hereby granted and agree that
upon completion of the underground facility and restoration of the surface, and, other than as set
forth herein, GRANTEE shall not be obligated for future maintenance and upkeep of the surface
area.
TO HAVE AND HOLD unto the City of Coppell, Texas, and the Grantor, their successors or
assigns for the purposes aforesaid and the premises above described.

BEING a tract of land out of the John F. Vest Survey, Abstract No. 1508, in the City Coppell,
Dallas County, Texas, and being part of a 8.902 acres tract of land described in deed to ARC SPEII,
L.L.C. recorded in Volume 97084, Page 2081, Deed Records, Dallas County, Texas, DRDCT), and
being more particularly described as follows;
COMMENCING at an iron rod found for the southeast corner of said 8.902 acre tract, and further
being the southwest corner of a tract of land described in deed to G.W. Venerable recorded in
Volume 68209, Page 0444, DRDCT, said rod also lying in the north line of Ruby Road (40 foot
R.O.W.);
THENCE, North 00 °2753" West, leaving the north line of Ruby Road along the common line of
said tracts at a call distance of 230 feet passing the northwest corner of said G.W. Venerable tract,
