RE: Oak Park Manufactured Horne Community Coppell, Texas
Dear lvtr. Harrington:
This letter confirms our conversation of yesterday. During that conversation I indicated to you that upon
the payment of Thirteen Thousand and no/10O Dollars ($13,000.00) from your client together with your
client's agreement to (a) repave the northern street in the community when the construction on easement
is completed, to (b) address the drainage problems in the northwest corner of the park as part of this
process and (c) be responsible for any other damage done by your client outside of ordinary wear and tear
on the roads and the minimal disruption as part of the contemplated construction, ARC is willing to
execute the casement agreement in this matter. This obligation on the part of ARC is expressly
conditioned upon ARC's understanding that this easement with the City of Coppell that ongoing
obligations udder this easement will be the responsibility of the City of Coppell. ARC will need to have
assurance's from the City of Coppell in this regard
ARC would further require that the $13,000.00 can be used by ARC to repave the cast and west streets in
the park, to address tenant issues in AkC's sole discretion and ARC will have no other obligation with
respect to the same. Upon the satisfaction of these conditions ARC would agree to release your client
from any additional liability to ARC or any of its tenants, except for darnace that occurs due to the gross
negligence or willful misconduct by your client its agents or employees, or any material damage to the
streets or other property in the park over and i:bove the normal wear and tear of the passage of equipment
over the same,
If this is acceptable to your client please contact tne directly and we will proceed to finalize this matter to
move. toward the completion of the project.
