described property, a drainage easement described in the attached Exhibit A and B

All fences removed will be replaced to original location and quality. Trees will
be replaced to an equivalent diameter and type tree, not necessarily on a tree
for tree basis but on an inch per inch basis.
Fences will be replaced if removed to original condition. Damages to the existing
landscape will be repaired. Any temporary construction easement granted will be
abolished upon ccmpletion of work.
This easement is also granted on the condition that Grantee do the following:
1.) After construction of the underground easement has been completed or after
any entry or repairs or maintenance, Grantee slnall return the surface area,
inclnding any fence, to its original condition as nearly as practical,
taking into consideration the nature of the work being performed.
2.) Grantor reserves the right to use and maintain the surface of the easement
strip for purposes which will not interfere with Grantee's rights hereby
granted, and agrees that upon completion of the underground facility and
restoration of the surface, Grantee shall not be obligated for future
maintenance and upkeep of the surface area.
3.) This will be a drainage easement for underground pipe only.
4.) This easement does not preclude Grantor from upgrading his fence on a future
date.
5.) This underground pipe will only be used for Kaye Street Drainage Improvements,
as sho~m on Construction Plans prepared for the City of Coppell by Carter &
Burgess, Inc.
For the purpose of constructing and maintaining drainage pipe and inlets
in. along, tq~on and
across said premises, with the right and privilege at all times of the grantee herein, bis or its agcnt~.
employees, workmen and representatives having ingress, egress, and regress in, along upon and across said
premises for the purpose of making additions to, improvements on and repairs to the said drainage faci 1 i ties
any part thereof.
