Box 478 Coppell, Texas 75011 RE: Drainage ditch failure adjacent to the Parkwood II subdivision, Coppell, Texas Dear Mr. Powell: This letter is in response to your letter dated February 10, 1986, in which you stated the City of Coppell's position regarding the pilot channel failure in the Parkwood Section Two subdivision. These improvements were accepted by the City of Coppell on September 12, 1984, and you provided no justification for your position that the failure was due to faulty workmanship. Your conclusion that the City of Coppell does not have a responsibility for repair of the channel is unacceptable to General and offers no basis for us, as you suggested, to assume this responsibility. General has already repaired City improvements and provided additional improvements during the development of our subdivisions when they were not specified in the construction plans. Now, we must insist that the City accept responsibility for the repair of this channel as they would with other City improvements. At this time, General and the Coppell Municipal Utility District No. 1, ("CMUD"), are ready to proceed with underground utility construction for Parkwood Section Three. Installation of the storm sewer improvements are dependent upon a repaired drainage channel. Therefore, General would like to initiate, monitor and complete the necessary construction procedures for the City as part of the Parkwood Section Three improvements, and have the City reimburse the costs of repair through a letter agreement. We will prepare this agreement as soon as your office notifies me of your concurrence. If you feel that this matter requires the attention of the City Council as we discussed, please notify me by March 10.
