Does the right-of-way deed you sent have the original signatures -the deed looks like a copy to me and
that is why I was asking. We are glad to file the documents, but we will need the originals to file. Since
the right-of-way and the temporary construction easements are contained within one document we will
go ahead and record those. They expire in two years. Would you check and see if we received the
original signatures.

Suzan,
I think it has been our expectation that the City of Coppell would file the Bethel Road right-of-way
dedication documents in conjunction with the overall project. As far as the temporary construction
easements go, I don't think we care whether or not those are recorded. I've copied Karen Correnty in
Duke's legal department on this a-mail so she can let us know if she thinks differently about either one of
those matters.
Good luck with the Emerson parcel at Royal Lane. They are trying to work with us to dedicate the overall
parcel to the property owners' association, and I think our position is that they should create two
separate legal descriptions so that one parcel could go to the POA and one to the City for the needed
corner clip.
Please let me know if you have any additional comments or questions. Good luck with the
commencement of the project.

I appreciate the easements - we only have the Emerson parcel left to acquire on this project. Not
having much luck with them. We have resolved our issues with the Corps of Engineers and will be
revising our permit to exclude the section of stream, from Freeport Parkway to Loch Lane. The
project should advertise in the 1st quarter of 2005.
I just want to make sure of the following:
Is Duke going to file the easements with the county and if so, we will need a copy of the filed
easements with the page and volume number for our records.
