KNOW ALL MEN BY THESE PRESENTS that the undersigned, TEXAS DUGAN LIMITED
PARTNERSHIP, a Delaware limited partnership having an address at c/o Duke Realty Corporation,
5495 Belt Line Road, Suite 360, Dallas, Texas 75254 (hereinafter called "Grantor"), for and in
consideration of Ten Dollars ($10.00) and other good and valuable consideration paid by the CITY OF
COPPELL having an address at 255 Parkway Boulevard, P.O. Box 478, Coppell, TX 75019 (hereinafter
called "Grantee"), the receipt and sufficiency of which are hereby acknowledged, has GRANTED,
SOLD and CONVEYED, and by these presents does hereby GRANT, SELL and CONVEY unto Grantee,
those tracts or parcels of land described in Exhibits A-1 and A-2 attached hereto and incorporated herein
by this reference (hereinafter called the "Property"). The Property is being granted in connection with
the widening of Bethel Road (the "Work").
TOGETHER WITH, as an appurtenance to the Property, temporary construction easements over
those portions of Grantor's retained land described in Exhibits B-1 and B-2 attached hereto and
incorporated herein by this reference. The temporary construction easements herein granted shall expire
on the earlier of: (i) completion of the Work; or (ii) two (2) years from the date of this deed.
By its acceptance of this Right of Way Deed, Grantee does hereby agree to repair and restore, at
Grantee's sole cost and expense, any portion of Grantor's land adjacent to the Property that may be
disturbed or adversely affected as a result of the Work to as close to the condition in which the same
existed immediately preceding the Work as is reasonably possible. Grantee further agrees to notify
Grantor within two (2) days (i) prior to the commencement of the Work, and (ii) prior to any repair or
restoration by Grantee or by Grantee's representatives as a result of the Work, and Grantee shall furnish
Grantor with evidence of insurance reasonably acceptable to Grantor upon request therefor.
For the Consideration, Grantor quitclaims to Grantee all of Grantor's right, title, and interest in
and to the Property, to have and to hold it to Grantee and Grantee's heirs, successors, and assigns
forever. Neither Grantor nor Grantor's heirs, successors, or assigns will have, claim, or demand any
right or title to the Property or any part of it.
When the context requires, singular nouns and pronouns include the plural.

Being 0.098 acre tract of land, more or less, situated in County of Dallas, State of Texas,
and being out of the John Vest Survey, Abstract No. 1508, and being a portion of that
certain called 141.721 acre tract of land conveyed by Duke-Weeks Realty Limited
Partnership, an Indiana limited partnership formerly known as Duke Realty Limited
Partnership to Texas Dugan Limited Partnership, a Delaware limited partnership by deed
recorded in Volume 2000251, Page 02678, of the Deed Records of Dallas County, Texas,
and being a portion of that certain Lot 1, Bock A, Duke-Freeport Addition, an addition to
the City of Coppell, as recorded in Volume 2001065, Page 00037, of the Plat Records of
Dallas County, Texas, which 0.098 acre tract of land, more or less, is more particularly
described as follows:
COMMENCING at a 1/2" iron rod with plastic cap stamped "A HALFF" found for the
North corner of the most Southerly East line of said Lot 1, Block A;
THENCE, South 00° 04' 24" West, along the said East line of said Lot 1, Block A, a
distance of 123.33 feet to the North line of a 6.67 foot right-of--way dedication for Bethel

Road and being the POINT OF BEGINNING;

line of Bethel Road, a distance of 384.15 feet to 5/8" iron rod with plastic cap stamped
"Transystems Corporation" found for corner in said proposed North right-of--way line of
Bethel Road;

Bethel Road, a distance of 41.18 feet to a 5/8" iron rod with plastic cap stamped
