Dear Ms. Rovillo:
I apologize for the length of time it has taken me to get back with you concerning our prior
meeting on the acquisition of the right-of-way from your property. Your previous letter had
several questions of which I believe we adequately covered during our meeting. Those questions
concerned the temporary easement and the impact fees. I explained to you that the impact fees
had no bearing on you as the property currently sets, but will only have an impact on someone
that would purchase the property and redevelop the property for a different use. You would not
need to pay a roadway impact fee if you pursue permits for additional fencing or parking on the
site.
The next issue that we discussed was the temporary slope easement. While it was not defined
during the course of our meeting, it was stated that you didn't have a problem with contractors
using the area outside of your fence on the back side of your property. During our discussion, it
was my understanding that a new issue was the fence along Sandy Lake Road. I informed you
that it was our desire to remove your existing retaining wall and fence and install a new retaining
wall that will be needed for the construction of the roadway and then install a new fence on top of
that retaining wall. With this letter I am providing a schematic of the new concrete retaining wall
and fence. As I stated, the City would pay the cost of the new concrete retaining wall and the
cost of the fence on top of the wall. Because we will be elevating the road in this area, installing
the fence on top of the new retaining wall this will give you greater security and privacy from the
vehicles on Sandy Lake Road. To remove the existing concrete wall and fence and install a new
concrete wall with a fence on top will obviously necessitate coming onto your property along
Sandy Lake Road. After removal of the fence, there would be a temporary fence provided
adjacent to Sandy Lake Road to provide security and to insure that no animals can leave your
property.
I know that you have a concern about privacy along the back side of your property once Sandy
Lake is constructed and as I stated we will still honor the original offer which will allow you the
opportunity to construct a fence along the back side of your property assuming you obtain the
necessary permits from the Building Inspection Department. Also, the offer from the City would
remain the same even though we are willing to remove the existing concrete wall and fence and
install a new wall and fence at a higher elevation. Therefore, if this is an acceptable concept to
you the following represents an offer from the City of Coppell for acquisition of right-of-way
from your property to construct Sandy Lake Road.
1. Acquisition of permanent right-of-way at $3.00/sq. ft. x 2,609 sq. ft. $7,827.00
2. Acquisition of temporary slope easement 150.00
3. Relocate existing business sign 150.00
4. Any damage associated with loss of screening 4,400.00
5. Additional compensation to provide additional parking on the Heartz 972.00
Road side of the property
6. No assessment for Sandy Lake Road improvements per the July 1,

returned I will start the process for the payment of the $13,499. When the check has been
processed, we can arrange a mutually agreeable time to meet to notarize the doctunents in
exchange for the check. If I have misinterpreted or misunderstood our previous conversations
please contact me. I hope I have included all concerns in this offer, but if I have failed to
accurately convey the information to you please let me know. I will be out of the office until
August 17, 1998, but will be happy to meet with you sometime after that date to discuss any
items of the offer. As an informational note, bids were opened for Sandy Lake on August 6,
1998 and I hope to award the project at the August 25, 1998 City Council meeting with a

Apparently your original letter was lost in the mall nnd
after ! called your office to see what the status was on June
15th Paula sent me n copy which I received today.
! do need to clear up some things though:
1.) I need assurnnee that the stakes marking my
property along Sandy Lake Road are moved to the correct
place to reflect the 206.45 ft. I currently own along the road
(213.95 ft. less the 7.5 ft. the City of Coppell ook to widen
Heartz Rd.) nnd then moved again to reflect aeeurntely the
footage along both Snndy Lake Road nnd Heartz Road after
the City of CoppeH has token land for the widening of Sandy
Lake Road and the southwest corner of Henrtz Road and
Snndy Lake Road.
2.) I need the ~mount of the temporary slope
easement spelled out nnd the fact that this tempory easement
at no time comes inside the present fence. This in effect
mefms that it only applies to lnnd west of my fence along
Sandy Luke Road and i need exact footuge of the temporary
easement. ! nm not objecting to the mount of money only
tht it covers only a very specific ~mount of land.
3.) ! do not understand wlmt you menn by the
stutement "but any redevelopment will require adhering to
the City of CoppeH Roadway Impact Fee Ordlnanee". This
seems to menn that I will allowed to bund the fence and
parking that I need but that ! would have to pay for the
privilnge. As this would be something the City of CoppeH
would be forcing me to do for the protection of my home and
business and ! could not agree to that. I reali~ that ! would

This letter is written as a follow-up to our meeting in the field on April 14, 1998. As I explained
in that meeting, the City hired an appraiser to evaluate the value of the property taking and any
damages associated with the construction of Sandy Lake Road adjacent to your property. Based
on my observations from your yard and from our conversations, it appears that your main
concern is the loss of screening by the removal of several trees adjacent to your fence. I concur
with the City appraiser that the loss of screening could have an adverse impact on your property.
As we verbally agreed to in the field, the following represents an offer from the City of Coppell
for the acquisition of right-of-way from your property to construct Sandy Lake Road.
1. Acquisition of permanent right-of-way at $3.00/sq. ft. x 2,609 sq. fi. $7,827.00
2. Acquisition of temporary slope easement 150.00

please note that no assessments will be placed against this property for the construction of the
roadway, but any redevelopment will require adhering to the City of Coppell Roadway Impact
Fee Ordinance.
Based on our verbal conversation it is my understanding that the above is acceptable to you.
Therefore, once this letter has been signed and returned I will start the process for the payment
of the $13,499.00. When that check has been processed, we can arrange a mutually agreeable

of-way expansion and the 48 inch CMP (corrugated metal pipe) with

turned on at the time we created the December 1997 survey. We have
modified the enclosed survey correcting the location of the fence
North of the North dog kennel building, and have added the metal
sign referred to in Ms. Rovillo's letter. Furthermore, we have
indicated the area within the chain link fence as dog kennel area,
added interior fences, and have relabeled both one story frame
buildings also as dog kennels. We sincerely apologize for any
inconvenience this may have caused you or Ms. Rovillo.
My original orders for this survey was a hand written fax (copy
attached). Again, I apologize for the computer glitch regarding
the aforementioned trees and pipe, as your original instructions to

At our meeting of March 11, 1998 nt 11:00 AM you gave me n
copy of fl~e new survey flint you nnd file City of CoppeH had done
by Brittnin & Crnwford wifll some of the higldighting flint I had
requested.
Let me begin with the sm-vey itself. When Brittain &
Crawford came to my house to do file survey flley explained to me
that they were redoing file survey according to "very specific
instructions from the City of CoppeH". Let me fist n few of the
errors on the survey:
1. Ail but one of the trees along Snndy Lake Road, with the
one exception nt the west end of the property, were left off.
Leaving 6 trees, fliree quite large, phas one m~dti-trunk tree at the
corner of file fences missing.
2. The northermnost kennel blfilding has suddenly become n
"one story frame house" with a portion of it chin-link fenced.
Really now, even file kennel r]ms have beexa eliminated.
3. The second kemlel has, in this survey, suddenly becomes a
"one story frame b~filding".
4. The sign for "BJR KENNELS" which also includes
"Boarding" and "462-0836" is also missing.
Does it not seem strnnge that all the trees that screen the
house nnd kennels nrc suddenly missing on your survey. Ail of the
kennel b~fildings nnd exercise r~ms nrc suddenly missing from your
new survey. Even the kenmei sign is n~issing from yom' sltrvey.
Sm-ely, since the City of CoppeH ordered this survey mid gave
"very specific instructions "ns to how it was to be done a person
has the right to wonder "with what intent" was this survey
ordered.
On the survey that you gave to me you forgot to highlight the
"temporary slope easement" tbnt the City would like. Was this
becanse it is at all tm~es inside file fence along Sm.dy Lake Road.
Seems to me fl~at it would be hupossible to do fl,e grading or slope
development yon req]dre without having to replace the fence. In
fact, oddly enough, yon show on your survey building n new fence
by the kennel building and in fact COlHhlg within 6 feet of the
kem~el bnilding. I would note flint for some reason your survey
shows the wood fence along Sandy Lake Road only going to the
front of the kem~el building nnd then turnhlg in toward it.
Obvionsly not trne and another source of wonderment to me.
I do not know why the City of CoppeH would wish to present
such an obviously innecurnte plan to me but it certainly seems to
indicate that they nrc unwilling to deal with the issnes and truth nt
this time.
Because of file vnrlons issues involved, the City of CoppeH
now needs to supply the following docmuents to me:
1. A copy of the appraisal used to determine the value of the
land flley are taking. Also the hall nnme of the appraiser and
company.
2. A copy of the letter/instrnctions to Brittain & Crnwford
Snrveyors. Also nny telephone notes, memos, etc. tlmt pertain to
my property. The snrveyors advised me when they were doing the
work that flley had "very specific h,strnctions" from the City
about how to do it. Raising many, many questions about why it
was so innccurnte.
3. As I requested before, I need n complete set of
'. engineering plans for fl~e eonstrnction that will affect my property
along Snndy Lake Road. ~Vhnt you bnve provided me so far does
not f~dly show file work to be done or how it is to be done.
I nm sm-e that you are aware that aH of these items should
be snpplied to me by law and I shah expect them by April 1, 1998.
The City of Coppeil has been far less thnn forthright nnd
honest with me through nH of these months nnd ! hope the City will
cooperate in the h~ture so that these matters cnn be resolved as
quickly as possible.

Gentlemen:
You recently did n survey of nay property nt 101 S. Henrtz
Road here in CoppeH for the City of Coppeil. At the time you
started to do the sltrvey you informed me that it was being done
lmder "very specific instructions from the City of CoppeH".
The copy of your slwvey that the City has given me has so
mnny innccuracies that ! feel compelled to question you about them
and am listing some below:
1. AH of the trees, ,vifla the exception of one on the
westernmost end of my property along Sandy Lake Road, are
somehow missing from yolw survey. This includes 6 trees, three
of which are quite large, plus one nudti-trunk tree flint is tipped
over toward tlae south from Sandy Lake Road. Hardly items that
couid be easily overlooked.
2. The northernmost kemlel building is referred to ns
a "one story franle house" that has a chain lhak fence around part
of it but somehow the dog exercise runs are not included. The
kennel building with nothing but kennel facilities for dogs could
hardly be mistaken for n house. Every other s~wvey has shown
the property and facilities for what they are - kennel facilities.
3. The second kennel b~dlding, located south of the
first facility nnd rmmlng east to west along a part of the southern
property line, is identified only as "one story frnme building" even
fl,ongh fl~is is also obviously a kennel building with dogs in
exercise pelts on the inside easily seen by tmyone.
4. The sign for "BJR KENNELS" which also includes
file words "Boarding" hud "462-0836" also seems to be missing
from your slwvey.
5. The wooden fence along Sandy Lake Road is shown
as ending 7' north of flae eastern corner of the kennel nnd turning
into the kennel building. The fact is the wooden fence continues
west [total it joh,s with a chain link fence that rm.s north and south
across n portion of the property, ha fact you have listed fids chain
li~dt fence as a stockade fence.
AH in nH hardly a survey to be proud of and because the
survey you prepared was done, according to your s~n'veyors, to
"very specific instructions from the City of CoppeH" it certainly
does make one wonder, in your survey you effectively eliminated
nH of the trees along Sandy Lake Road, misidentified kennel
buildings and exercise rams for the dogs ns well as the sign for the
business, wrongly identified where the fences were nnd what kind
they were, etc. nanking it hard to believe tlmt Brittain & Crnwford
could have nuach of a reputation ha their business.
Because of nH of the above i have many reservations about
the netlons of your company and the City of Coppel's intentions in
ordering this survey.
As you know ! nm entitled by law to have copies of nH
correspondene, notes, and nnything pertaining to your
arrangements with flae City of CoppeH nnd most specifically the
"very specific instructions from the City of CoppeH" concerning
this s~u-vey of my property.
Since the City of Coppell is seeking to "take" sonae of my
property you wH! amderstand why by law you must supply me with
nH of the documents pertaining to it.

At 2:30 PM today I called at your office to pick up the
items that I hud requested in my letter of November 17, 1997
nnd spoke first with your secretary, Pnuln Crocker, nnd then
with you also. I was advised that you hud done nothing about
obtaining these items nnd didn't know when you could make
them available for me.
I can only assume and hope that this will not take too

the City of CoppeH concern yourselves with is the price per
square foot that you would offer me for the footage I own
along Sandy Luke Road. Obviously there are others.
After I received your May 6th letter I made an
appointment to visit with you nt 10:00 AM on June 23, 1997
to discuss the situation and try to resolve the multitud~
problems involved. At that meeting we discussed the fact that
you would be coming right up to the ft~te and how many
trees would be destroyed. These trees currently screen the
house, the kennels and the kennel runs from the noise and
pollution of the current Snndy Lake Road plus they of course
beautify and enhnnce the property. You niso plan to take

not only create even more noise and pollution to the house
bedrooms especially but effects the driveway, kennel sign,

distance from the house and kennels.

At our June 23rd meeting i advised you that the City of

my home and kennel business to excessive noise and pollution
that win greatly impair the quality of life in my home and my

to conduct my kennel business but that there cnnnot be any
excessive noise. Between the increased noise and pollution
and how close the n~w road will be to my kennel buildings

areas. This will of course create a problem for me with both
the City of Coppefl and my neighbors.
Both the City of CoppeH and you yourself must realize
that the taking of appro~y l/4th of my Henrtz Road
frontage, the large trimrgle of property nt my corner of Sandy
Lake Road and Heartz Road plus removing ali the trees along
Sandy Lake Road and br~ it to within very few feet of
my home's bedrooms, the kenneis~ nnd kennel exercise area
will so greatly, dimhd~-th~vnim~t my~ pi~umT ns to make
it almost impossible to sen either as n home or kennel
business.
This home nnd kennel business constitute my entire
estate as wen as my means of support both now and in the
future. My only other source of income is approximately
$550 a month from Social Security. Thin obvious utterly
devestatlng devaluation of my propert~y means that ! will be
both unable to sen the property for its greatest potential
value either to provide for my own care (I nm dOW 70 years
old) or to create tm estate for my children whether they wish
to continue the kennel operation or set the property.

engineering plan for Sandy Lake Road from Heather Glen to

As you may be aware, the City of Coppell has been working on the design of Sandy Lake from Denton
Tap Road to MacArthur Blvd. since 1993. There have been several issues associated with this project
over the last few years, of which the most significant have been: landscaping, TU power lines, and the
relocation of the water supply to the Town of Flower Mound. Each of those issues were discussed in
public meetings. The landscaping issues were resolved and landscape plans are available at City Hall.
The power line issue was addressed by relocating the roadway slightly north to avOid the existing power
lines along the south side of Sandy Lake Road. Council has made a commitment to challenge the upgrade
of the power lines at some point in the future when TU Electric makes application for an upgrade. The
water line issue will be resolved on June 1st of this year when the Town of Flower Mound obtains an
alternate water supply from the Upper Trinity River Authority. When that supply is obtained, the City
of Coppell will be able to take the water line in Sandy Lake out of service in the winter of 1997 and the
early part of 1998.
Because several major challenges associated with the project have been resolved or will be resolved in
the near future, the City of Coppell is in the process of acquiring the right-of-way needed for the
construction of Sandy Lake Road. It is anticipated that the project will start in the fall of 1997 with the
lowering of the Flower Mound water line being the first phase of the project. The entire roadway project
will take upwards of two years to complete.
To proceed with the construction, right-of-way will be required from your property. With this letter, I
have provided a copy of the right-of-way documents and in some cases temporary easement documents
necessary for the successful completion of Sandy Lake-Road. Prior to the City expending funds to obtain
the services of an appraiser, the City would like to set up a meeting to discuss the acquisition with you.
This meeting will be used to determine if a purchase price, agreeable to both parties, can be negotiated
'* withoUt the added expense of appraisal fees.

right-of-way from your property. Because of busy work schedules, the City of Coppell is willing to meet
not only during the typical workday but after hours and on weekends. This is a very important project

THAT, ELXZABE~ ROVI~J~), herein aft~ referred to as GRANTOR, in
consideration of the sum of ONE DOLLA~ and other good and valuable
consideration in hand paid by City of Co~pell, Texas, receipt of which is
hereby acknowledged, does hereby gra~f,~argain, sell and convey unto
City of Coppell, Texas, ("GRANTEE")F the free and uninterrupted use,
liberty and privilege of passage in, ~long, upon and across the following
described property owned by Grantor/~or the purpose of a temporary slope
easement for grading, sloping or~illing along, upon and across said
property to provide a more subtle grade change transition, across
Grantor's main tract with the right and privilege during construction, of
the GRANTEE herein, its agents,/employees, workmen and representatives
having ingress, egress, and ~egress in along upon and across said
premises for the purpose of grading, sloping, or filling along, upon and
across said temporary slope ~asement.
Said temporary slope easement is further described in Exhibits "A"
and "B" attached hereto an~ made a part hereof for all purposes.
After construction h~s been completed, GRANTEE shall, except for
removed obstructions, r~urn the surface area of the temporary slope
easement to its origina~ condition as nearly as practical taking into
consideration the natur~ of the work being performed. GRANTOR reserves
the right to use and maintain the surface of the temporary slope easement
strip for purposes which will not interfere with GRANTEES rights hereby
granted and agree t~at, GRANTEE shall not be obligated for future
maintenance and upkeep of the temporary slope easement.

conveyed to Earl C. Rovillo, Jr. and wife Elizabeth Rovillo, by the deed
recorded in Volume 73063, Page 2144 of the Deed Records of Dallas County,
Texas. 'Said 0.032 acres being more particularly described by metes and
bounds, as follows:
BEGINNING at a point lying within said Rovillo Tract, located
S 00° 17' 23" W 25.38 feet; THENCE N 56° 30' 11" W 14.88 feet
