Billingsley Crow/Billingsley Investment Company 4100 International Pkwy, Suite 1100 Carrollton, TX 75007 RE: Property at S.H. 121 and Sandy Lake Road West Sandy Lake Road Project # ST 99-02 Dear Mr. Billingsley: This letter is written as a follow-up to our prior conversation concerning land at the southwest comer of S.H. 121 and Sandy Lake Road. It is my understanding that you have recently purchased this property. The City of Coppell is in the process of obtaining right-of-way for the construction of West Sandy Lake Road. The timetable for the bidding of West Sandy Lake Road is the 4th quarter of 2004. Therefore, it is imperative that we obtain the right-of-way in an expeditious manner. Included with this letter are the right-of-way, drainage, and temporary construction easement documents required from this property. Through the years there have been numerous attempts to arrive at a developers. agreement with the owners of this parcel of land concerning the future construction of Royal Lane. With this letter, I am providing copies of the right-of-way for both Sandy Lake Road and Royal Lane, a drainage easement at the northeast comer of the property, and a temporary construction easement. Once you have had an opportunity to review these documents and their potential impact on the property, I would like to discuss with you how you would like to see the City go about obtaining the necessary right-of-way and easements. Several options are available: 1) a developers agreement whereby certain roadway impact fees are credited against the property based on the value of the right-of-way; or 2) a developers agreement concerning the construction of Royal Lane as a potential offset for the dedication of the right-of-way; or 3) an out and out purchase of the right-of-way by the city at a fair market value.
