COUNTY OF DALLAS
THAT, Billingsley 121 Coppell, Ltd., known herein as GRANTOR:" in
consideration of the sum of Ten and No/lOO Dollars ($10,00) and other good and
valuable consideration paid by the City of Coppell, Texas, a municipal corporation
of Dallas County, Texas, receipt of which is hereby acknowledged, does hereby
grant, bargain, and convey to said City (GRANTEE), it successors and assigns, a
permanent right-of-way over and across the tract of land hereinafter described (the
"Easement Areatl) to construct, reconstruct and perpetually maintain a public street
and/or drainage facilities and utilities, together with all necessary appurtenances
thereto, and with the right and privilege at any and all times, to enter said permanent
right-of-way, or any part thereof, as is necessary to the proper use of any C?ther right
granted herein, and for the purpose of constructing, reconstructing and maintaining
said public street and/or drainage facilities and utilities, and for making connections
therewith, in, upon and across said permanent right-of-way.

Said Easement Area being described in Exhibit ''B'' attached hereto and
made a part hereof for all purposes.
GRANTEE may remove from the Easement Area, such fences, buildings and other
obstructions as may be found upon said property. After construction has been
completed or after any entry for repairs or maintenance, GRANTEE shall, except for
removed obstmctions, return the surface area of the easement strip to its original
condition as nearly as practical taking into consideration the nature of the work
being perfonned. GRANTOR reserves the right to use and maintain the sUlface of
the easement strip for pUIposes which will not interfere with GRANTEE'S rights
hereby granted and agree that, GRANTEE shall be obligated only for future
maintenance and upkeep of the public street and/or drainage facilities and utilities
and appurtenances constructed by GRANTEE thereon. '

Texas. Said t 156 acres tract of land being more particularly described by metes and
bounds as follows:
Beginning at a brass disk in concrete TXDOT monument found for comer on the east right
of way line of State Highway No 121 (a variable width right of way), same being on south
right of way line of Sandy Lake Road (a variable width right of way), and also being a
northwest corner of said TiE Northpoint Partners. Ltd. tract, from which a brass disk in
concrete TXDOT monument found on the east right of way line of said State Highway No.

privilege of passage in, along, upon and across the following described property
owned by Grantor (the "Drainage Easement") for the purpose of constructing and
maintaining an underground drainage system across Grantor's main tract with the
right and privilege at all times, of the GRANTEE herein, its agents, e~ployees,
workmen and representatives having ingress, egress, and regress in. along, upon and
across said Drainage Easement for the purpose of making additions to,
improvements on and repairs to said drainage system or any part thereof.

Said Drainage Easement being described in Exhibit liB" attached hereto and
made a part hereof for all purposes.
That in consideration of the benefits above set out, GRANTEE will remove
from the Drainage Easement, such fences. buildings and other obstructions as may
be found upon said property. After construction of the underground drainage system
has been completed or after any entry for repairs or maintenance, GRANTEE shall,
except for removed obstructions, return the surface area of the Drainage Easement
to its original condition as nearly as practical taking into consideration the nature of
the work being performed. GRANTOR reserves the right to use and maintain the
surface of the Drainage Easement for purposes which will not interfere wit11
GRANTEE'S rights hereby granted and agree that ~ upon completion of the
tmderground facility and restoration of the surface, GRANTEE shall not be
obligated for future maintenance and upkeep of the surface area.
