You will also find a second list, (pages 3 & 4) with the names of affected Spanish Moss Court residents, not willing to grant easement for this project. We suggest that at least the two residents of 331 and 335 Spanish Moss Court also be contacted since we need to receive easement along their side yards for this drainage improvement. Also attached (page 5) please find a list of concerns that staff has expressed regarding any alteration to the storm sewer alignment, which has been suggested by some of the Kaye Street residents. Kaye Street Drainage Project Concerns Regardin~ Alteration of the 15" Storm SewerAliu,~ment - Realignment may result in capacity reduction and improper functioning of the system. - Construction of 15" storm system in the existing I0'(+_~ utility easement would require disconnection, relocation and re-connection. (Electric service- Cable T.V. Service - Telephone Service) - The realignment may also require the removal of more existing Oak trees and replacement of landscaping replacement. - Staff requests that the Legal Council give a definition for utility easement as it applies to the existing I0'(+) utility easement on the south side of Spanish Moss Court lots and whether it can be used as drainage easement. Permission would need to be granted by each affected resident in order to conduct the field survey. - Generally, such' realignment would result in a great deal of inconvenience for all affected residents, and the project would be further delayed.
