RE: North Kaye Street Drainage Improvement
On September 10, 1990 Staff began making personal contact with each
affected resident adjacent to the proposed drainage improvement on
North Kaye Street.
Basically, Staff contacted and met with 32 out of 35 residents to
provide a status report on proposed drainage improvement, to inform
residents of City's need for 10' (+-) of drainage easement, and to
ask permission so that a field survey can be conducted.
The result indicates that three (3) residents are not in favor of
the field survey. Staff was unable to contact three (3) residents.
Please note that although Staff has made every effort to expedite
this project, it appears that even the survey can not be conducted
for easement and construction plan preparation. In addition, as
per the attached list, twelve (12+-) residents will not grant the
necessary easement. According to Larry Jackson, City Attorney, we
must have written permission to enter onto one's property. The
only other option to consider at this point would be condemnation,
to be able to make this particular improvement a reality.
Upon your direction, we will prepare an agenda item for the
December 11, 1990 City Council meeting to provide status report of
this project.
